(1) The jurisdiction of the Supreme Court to ordinarily determine any such question as aforesaid may be invoked by the President by a written reference addressed to the Chief Justice, or by any citizen by a petition in writing addressed to the Supreme Court. ... (1) Subject to subsection (2), the High Court has original jurisdiction to determine any question as to the interpretation or application of this Constitution.
(2) Where —
(a) any question as to the interpretation or application of this Constitution arises in any proceedings in a subordinate court; and
(b) that court is of the opinion that the question involves a substantial question of law,
the court may, and shall if a party to the proceedings so requests, refer the question to the High Court for determination. (Sec. 134)

b. a matter relating to a violation or contravention of this Constitution;

2. Subject to Article 28 (2), where a question relating to this Constitution arises in a court, the person presiding in that court shall refer the question to the Constitutional Court.
3. Subject to Article 28, a person who alleges that—
a. an Act of Parliament or statutory instrument;
b. an action, measure or decision taken under law; or
c. an act, omission, measure or decision by a person or an authority; contravenes this Constitution, may petition the Constitutional Court for redress.
4. A decision of the Constitutional Court is not appealable to the Supreme Court. (Art. 128)
