Any pleader [plaideur] may raise the exception of unconstitutionality of a law before any jurisdiction.
The jurisdiction referred to [the matter] postpones deciding and remits the exception before the Constitutional Court. In this case, the Constitutional Court decides in the fifteen days of its referral.

• on the constitutionality of the laws before their promulgation;
• on the constitutionality of the internal regulations of the Senate and of the Chamber of Deputies before their implementation
• on the orders
For the same purposes, the laws in general may be referred to the Constitutional Council, before their promulgation, by the President of the Republic, the President of the Senate, the President of the Chamber of Deputies, a group of fifteen (15) Deputes or of (10) Senators.
The law determines the modalities of organization and of functioning of the Constitutional Council as well as the other entities enabled to refer a matter to it. (Art. 190ter-5) - FrenchLe Conseil Constitutionnel veille et statue lorsqu'il est saisi:
a. sur la constitutionnalité des lois organiques avant leur promulgation;
b. sur la constitutionnalité des règlements intérieurs du Sénat et de la Chambre des Députés avant leur mise en application.

- English1. Appeals of unconstitutionality against laws or statutory rules may be lodged by one fifth of the General Council, the Head of Government and three Local Councils. One fifth of the General Council may lodge an appeal of unconstitutionality against the Rules of Procedure of the Chamber. The President of the Republic may ask the Constitutional Court to conduct a prior review of the constitutionality of any rule contained in legislation that has been submitted for enactment, any international treaty submitted to him for ratification or any international agreement sent to him for signature.

- EnglishThe international engagements specified in Articles 114 to 116 must be deferred before their ratification to the Constitutional Court, either by the President of the Republic, or by the Prime Minister, or by the President of the National Assembly or by one-tenth of the Deputies, or by the President of the High Council of the Collectivities or by one-tenth of the National Councilors.
The Constitutional Court verifies, within a time of one month, if these engagements contain a clause contrary to the Constitution.

- EnglishIf the Chancellor of Justice finds that a legislative instrument passed by the legislative or executive branch of government or by a local authority is in conflict with the Constitution or a law, he or she makes a proposal to the body which passed the instrument to bring it into conformity with the Constitution or the law within twenty days. If the instrument is not brought into conformity with the Constitution or the law within twenty days, the Chancellor of Justice refers the matter to the Supreme Court who may declare the instrument invalid. Everyone shall have the right to request from the Constitutional Court, by a writ of amparo, the protection of his or her constitutionally recognized fundamental rights, liberties and guarantees, under the terms of the law and in accordance with the provisions contemplated in the following subparagraphs:
a) A writ of amparo may only be filed against acts or omissions of public authorities, that are injurious to the fundamental rights, liberties and guarantees, once all other means of ordinary appeal have been exhausted;
