- EnglishIf the Constitutional Council, on a referral from the President of the Republic, from the Prime Minister, from the President of one or the other Houses, or from sixty Members of the National Assembly or sixty Senators, has held that an international undertaking contains a clause contrary to the Constitution, authorization to ratify or approve the international undertaking involved may be given only after amending the Constitution. 1. The Council of Constitutional Inquiry shall have powers to investigate constitutional disputes. Should the Council, upon consideration of the matter, find it necessary to interpret the Constitution, it shall submit its recommendations thereon to the House of the Federation.
2. Where any Federal or State law is contested as being unconstitutional and such a dispute is submitted to it by any court or interested party, the Council shall consider the matter and submit it to the House of the Federation for a final decision.
3. When issues of constitutional interpretation arise in the courts, the Council shall:
a. Remand the case to the concerned court if it finds there is no need for constitutional interpretation; the interested party, if dissatisfied with the decision of the Council, may appeal to the House of the Federation.
b. Submit its recommendations to the House of the Federation for a final decision if it believes there is a need for constitutional interpretation.

- English1. Preventive review of the constitutionality may be requested from the Constitutional Court:
a) By the President of the Republic, in respect of any rule contained in an international treaty or agreement that is referred to it for ratification, as well as in respect of any provision of legislation it has been sent for promulgation as a law, legislative decree or decree-law;
b) By, at least, fifteen Deputies in full exercise of their functions or by the Prime Minister in respect of any rule contained in a legislation act sent to the President for promulgation as law subject to approval by a qualified majority.

- EnglishWhen on the occasion of a pending legal proceeding before a jurisdiction, an exception of unconstitutionality is raised, the Constitutional Council may be referred to the matter on remand from the Court of Cassation.
If the provision is declared unconstitutional, the Constitutional Council returns it to the Parliament which decides sovereignly on the case. The new provision is promulgated. - English1. The following may make application to the Constitutional Tribunal regarding matters specified in Article 188:
1) the President of the Republic, the Marshal of the Sejm, the Marshal of the Senate, the Prime Minister, 50 Deputies, 30 Senators, the First President of the Supreme Court, the President of the Chief Administrative Court, the Public Prosecutor-General, the President of the Supreme Chamber of Control, the Commissioner for Citizens' Rights,
2) the National Council of the Judiciary, to the extent specified in Article 186, para. 2;
3) the constitutive organs of units of local self-government;
4) the national organs of trade unions as well as the national authorities of employers' organizations and occupational organizations;
5) churches and religious organizations;
6) the subjects referred to in Article 79 to the extent specified therein.

6.) podmioty określone w art. 79 w zakresie w nim wskazanym.
2. Podmioty, o których mowa w ust. 1 pkt 3-5, mogą wystąpić z takim wnioskiem, jeżeli akt normatywny dotyczy spraw objętych ich zakresem działania. (Art. 191)

- EnglishThe organic laws, before their promulgation and the regulations of the National Assembly before their implementation [mise en application], must be submitted to the Constitutional Council which decides concerning their conformity with the Constitution.
