The Constitutional Court pronounces whether state treaties are unlawful. Art. 140 shall apply to political, to law-modifying and to law-amending state treaties and to state treaties modifying the Treaty basis of the European Union, Art. 139 to all other state treaties with the following proviso,

(2) An appeal shall lie from the decisions of the Court of Appeal to the Supreme Court as of right in the following cases–

- EnglishThe Supreme Tribunal of Justice shall guarantee the supremacy and efficacy of constitutional rules and principles; it shall be the supreme and ultimate interpreter of the Constitution and shall see to the uniform interpretation and application of the same. Interpretations established by the Constitutional Division concerning the contents or scope of constitutional rules and principles are binding on the other division of the Supreme Tribunal of Justice and on all of the other courts of the Republic. - EnglishIf the Chancellor of Justice finds that a legislative instrument passed by the legislative or executive branch of government or by a local authority is in conflict with the Constitution or a law, he or she makes a proposal to the body which passed the instrument to bring it into conformity with the Constitution or the law within twenty days. If the instrument is not brought into conformity with the Constitution or the law within twenty days, the Chancellor of Justice refers the matter to the Supreme Court who may declare the instrument invalid. (Sec. 142)

Everyone shall have the right to request from the Constitutional Court, by a writ of amparo, the protection of his or her constitutionally recognized fundamental rights, liberties and guarantees, under the terms of the law and in accordance with the provisions contemplated in the following subparagraphs:
a) A writ of amparo may only be filed against acts or omissions of public authorities, that are injurious to the fundamental rights, liberties and guarantees, once all other means of ordinary appeal have been exhausted;
b) A writ of amparo may be requested through a simple petition; it would be of an urgent nature, and its procedure must be based on the principle of summary treatment.

- English(1) A person who alleges that any provisions of this Constitution, other than a provision of Chapter III3, has been contravened and that the person’s interest is being or is likely to be affected by the contravention may, subject to this article, apply to the Constitutional Court for redress.
(2) The Constitutional Court may decline to entertain an application under clause (1) where the Court is satisfied that the applicant has obtained redress for the contravention under any law and where the applicant has obtained redress in the Constitutional Court for any matter for which an application may be made under clause (1), a court shall not entertain any application for redress for such matter except on appeal from a decision of such court.
(3) Where the Constitutional Court on an application under clause (1) is satisfied that adequate means of redress for the contravention alleged are or have been available to the person concerned in any other court under any other law, the Court may hear the application or transfer the application to the appropriate court for grant of redress in accordance with law.
(4) Upon hearing an application under clause (1), the Constitutional Court may-
(a) declare any act or omission which is the subject of the application to be a contravention of this Constitution;
(b) declare any law or the provision of any law which contravenes this Constitution to be void;
(c) grant any remedy available to the Supreme Court against any person or authority which is the subject of the application or which is a party to any proceedings before the Constitutional Court, as the Court considers appropriate.

(6) Where in the course of any proceedings in any court, other than the Court of Appeal or the supreme court sittings as the Constitutional Court, or tribunal, a question arises with regard to whether there has been or is likely to be a contravention of this Constitution, other than Chapter III, the court or tribunal shall, if it is satisfied that the question is not frivolous or vexatious or has not already been the subject of a decision of the Constitutional Court or the Court of Appeal, immediately adjourn the proceedings and refer the question for determination by the Constitutional Court.
(7) Where in an application under clause (1) or where a matter is referred to the Constitutional Court under clause (6), the person alleging the contravention or risk of contravention establishes a prima facie case, the burden of proving that there has not been a contravention or risk of contravention shall, where the allegation is against the State, be on the State.

- EnglishThe Constitutional Council shall have the competence to guarantee the respect of the Constitution, to interpret the Constitution and the Laws adopted by the National Assembly and definitively reviewed by the Senate.
The Constitutional Council has the right to examine and to decide on litigations related to the elections of the Members of the National Assembly and to the elections of the Senators. (1) The Constitutional Court decides, by means of [an] order [arret], on the conformity of laws with the Constitution.
(2) The Constitutional Court may be referred to [a matter], under title of preliminary opinion [titre prejudiciel], following the modalities to be determined by the law, by any jurisdiction to decide on the conformity of the laws, with the exception of the laws concerning approval of treaties, with the Constitution.
(3) The Constitutional Court will regulate the disputes of attribution according to the mode determined by the law.
(4) The attributions of the Constitutional Court may be extended by a law voted by a qualified majority gathering at least two-thirds of the votes of the members of the chamber of deputies, the vote by proxy not being admitted.

- EnglishAny person [particulier] can, either directly, or by the procedure of the plea [exception] of unconstitutionality invoked before a jurisdiction in a matter that concerns him, refer the Constitutional Court to [a matter] concerning the constitutionality of the laws and of the treaties.
In the case of [a] plea of unconstitutionality, the referred jurisdiction postpones [its] decision and grants [impartit] the petitioner a time period of one (1) month from the notification of the decision to refer [the matter] to the Constitutional Court. (Art. 180) - FrenchTout particulier peut, soit directement, soit par la procédure de l’exception d’inconstitutionnalité invoquée devant une juridiction dans une affaire qui le concerne, saisir la Cour constitutionnelle sur la constitutionnalité des lois et des traités.
En cas d’exception d’inconstitutionnalité, la juridiction saisie surseoit à statuer et impartit au requérant un délai d’un (1) mois à partir de la signification de sa décision pour saisir la Cour constitutionnelle. (Art. 180)
