The Constitutional Court pronounces whether state treaties are unlawful. Art. 140 shall apply to political, to law-modifying and to law-amending state treaties and to state treaties modifying the Treaty basis of the European Union, Art. 139 to all other state treaties with the following proviso,

The Constitutional Court is the highest jurisdiction of the State in constitutional matters. It is the judge of the constitutionality of the law and it guarantees the fundamental rights of the human person and the public freedoms. It is the regulatory organ of the functioning of the institutions and of the activity of the public powers. (Art. 114)

- EnglishIf the Chancellor of Justice finds that a legislative instrument passed by the legislative or executive branch of government or by a local authority is in conflict with the Constitution or a law, he or she makes a proposal to the body which passed the instrument to bring it into conformity with the Constitution or the law within twenty days. If the instrument is not brought into conformity with the Constitution or the law within twenty days, the Chancellor of Justice refers the matter to the Supreme Court who may declare the instrument invalid. - EnglishWhen on the occasion of a pending legal proceeding before a jurisdiction, an exception of unconstitutionality is raised, the Constitutional Council may be referred to the matter on remand from the Court of Cassation.
If the provision is declared unconstitutional, the Constitutional Council returns it to the Parliament which decides sovereignly on the case. The new provision is promulgated. Everyone shall have the right to request from the Constitutional Court, by a writ of amparo, the protection of his or her constitutionally recognized fundamental rights, liberties and guarantees, under the terms of the law and in accordance with the provisions contemplated in the following subparagraphs:
a) A writ of amparo may only be filed against acts or omissions of public authorities, that are injurious to the fundamental rights, liberties and guarantees, once all other means of ordinary appeal have been exhausted;
b) A writ of amparo may be requested through a simple petition; it would be of an urgent nature, and its procedure must be based on the principle of summary treatment.

- EnglishThe organic laws, before their promulgation and the regulations of the National Assembly before their implementation [mise en application], must be submitted to the Constitutional Council which decides concerning their conformity with the Constitution.

(1) The Constitutional Court decides, by means of [an] order [arret], on the conformity of laws with the Constitution.
(2) The Constitutional Court may be referred to [a matter], under title of preliminary opinion [titre prejudiciel], following the modalities to be determined by the law, by any jurisdiction to decide on the conformity of the laws, with the exception of the laws concerning approval of treaties, with the Constitution.
(3) The Constitutional Court will regulate the disputes of attribution according to the mode determined by the law.
(4) The attributions of the Constitutional Court may be extended by a law voted by a qualified majority gathering at least two-thirds of the votes of the members of the chamber of deputies, the vote by proxy not being admitted.
