– the regulations of the National Assembly and of the Senate, the regulations of procedure of the Constitutional Court and the regulations of the Economic, Social and environmental Council, before their implementation, concerning their conformity with the Constitution;
– the regulations of the independent administrative authorities determined by the law, before their implementation, concerning their conformity with the Constitution;
– the conflicts of attribution between the institutions of the State;
– the regularity of the presidential [and] parliamentary elections, and of the operations of the referendum of which it proclaims the results.
The Constitutional Court is referred to [the matter] in case of dispute concerning the validity of an election, by any elector, any candidate, any political party or delegate of the Government under the conditions provided for by the organic law on the Constitutional Court. - EnglishAny person may file an initiative to start the procedure for the assessment of constitutionality and legality.
The procedure before the Constitutional Court for the assessment of constitutionality and legality may be initiated by the court, other state authority, local self-government authority and five Members of the Parliament.
The Constitutional Court itself may also initiate the procedure for the assessment of constitutionality and legality.
During the procedure, the Constitutional Court may order to stop the enforcement of an individual act or actions that have been taken on the basis of the law, other regulation or general act, the constitutionality, i.e. legality of which is being assessed, if the enforcement thereof could cause irreparable damage. - EnglishThe declaration of unconstitutionality of a law and its abrogation [derogación], may be solicited, by anyone who considers himself injured in his direct, personal, and legitimate interest:
1) By way of action that must be brought [entablar] before the Supreme Court of Justice;
2) By way of exception. which may be opposed in any judicial proceeding; and
3) Also[,] the Jurisdictional Organ that takes cognizance in any Judicial proceeding may solicit[,] of office[,] the declaration of unconstitutionality of a Law and its abrogation before dictating a decision [resolución].
In the cases contemplated in numerals 2) and 3), the activity [actuaciones] must be elevated to the Supreme Court of Justice[,] the procedure following from the moment of summons for decision [sentencia], after which the judicial procedure of the partial question in the sphere of the resolution concerning the unconstitutionality must be suspended.
