- English(1) Subsection (2) applies in any proceedings in which a court determines whether a provision of primary legislation is compatible with a Convention right.
(2) If the court is satisfied that the provision is incompatible with a Convention right, it may make a declaration of that incompatibility.
(3) Subsection (4) applies in any proceedings in which a court determines whether a provision of subordinate legislation, made in the exercise of a power conferred by primary legislation, is compatible with a Convention right.
(4) If the court is satisfied—
(a) that the provision is incompatible with a Convention right, and
(b) that (disregarding any possibility of revocation) the primary legislation concerned prevents removal of the incompatibility, it may make a declaration of that incompatibility.
(5) In this section “court” means—
(a) the Supreme Court;
(b) the Judicial Committee of the Privy Council;
(c) the Court Martial Appeal Court;
(d) in Scotland, the High Court of Justiciary sitting otherwise than as a trial court or the Court of Session;
(e) in England and Wales or Northern Ireland, the High Court or the Court of Appeal.

- English1. Anyone who considers that any of the rights guaranteed to him by the Constitution has been, is being or is likely to be infringed may, independently of any other possible legal remedy, apply to the Supreme Court to enforce that right.
2. The Supreme Court may make such orders, issue such writs and give such directions, including the payment of compensation, as it considers appropriate to enforce the right. 5. އެ ޙައްޤެއް ނުވަތަ އެ މިނިވަންކަމެއް ހިފަހައްޓައިފައިވާ މިންވަތައްވުރެ ކުޑަކޮށް ހިފަހައްޓައިގެން ބޭނުންވާ މަޤްސަދު ޙާޞިލްކުރެވިދާނެތޯ.
6. އެ ޙައްޤެއް ނުވަތަ އެ މިނިވަންކަމެއް ހިފަހައްޓައިފައިވަނީ މި މާއްދާގެ (ށ) ގެ ދަށުން ނަމަ، އިސްލާމްދީނުގެ އަސްލުތައް ރައްކާތެރިކުރުމަށްޓަކައި އެ ހައްޤެއް ނުވަތަ އެމިނިވަންކަމެއް ކޮންމެހެން ހިފަހައްޓާންޖެހޭތޯ.
