Judicial Protection
- English(1) When interpreting the Bill of Rights, a court, tribunal or forum –
(a) must promote the values that underlie an open and democratic society based on human dignity, equality and freedom;
(b) must consider international law; and
(c) may consider foreign law.
(2) When interpreting any legislation, and when developing the common law or customary law, every court, tribunal or forum must promote the spirit, purport and objects of the Bill of Rights.
(3) The Bill of Rights does not deny the existence of any other rights or freedoms that are recognised or conferred by common law, customary law or legislation, to the extent that they are consistent with the Bill. (Sec. 39)

- EnglishHuman and citizens' rights and freedoms are protected by the court.
Everyone is guaranteed the right to challenge in court the decisions, actions or omission of bodies of state power, bodies of local self-government, officials and officers.
Everyone has the right to appeal for the protection of his or her rights to the Authorised Human Rights Representative of the Verkhovna Rada of Ukraine.
Everyone shall be guaranteed the right to lodge a constitutional complaint to the Constitutional Court of Ukraine on grounds defined in this Constitution and under the procedure prescribed by law.
After exhausting all domestic legal remedies, everyone has the right to appeal for the protection of his or her rights and freedoms to the relevant international judicial institutions or to the relevant bodies of international organisations of which Ukraine is a member or participant.
Everyone has the right to protect his or her rights and freedoms from violations and illegal encroachments by any means not prohibited by law. (Art. 55) - UkrainianПрава і свободи людини і громадянина захищаються судом.
Кожному гарантується право на оскарження в суді рішень, дій чи бездіяльності органів державної влади, органів місцевого самоврядування, посадових і службових осіб.
Кожен має право звертатися за захистом своїх прав до Уповноваженого Верховної Ради України з прав людини.
Кожному гарантується право звернутись із конституційною скаргою до Конституційного Суду України з підстав, установлених цією Конституцією, та у порядку, визначеному законом.
Кожен має право після використання всіх національних засобів юридичного захисту звертатися за захистом своїх прав і свобод до відповідних міжнародних судових установ чи до відповідних органів міжнародних організацій, членом або учасником яких є Україна.
Кожен має право будь-якими не забороненими законом засобами захищати свої права і свободи від порушень і протиправних посягань. (Стаття 55)

- English1. Subject to clause (5), if any person alleges that any of the provisions of Articles 11 to 266 inclusive has been, is being or is likely to be contravened in relation to him, then, without prejudice to any other action with respect to the same matter which is lawfully available, that person may apply for redress to the High Court which shall—
a. hear and determine any such application;
b. determine any question arising in the case of any person which is referred to it in pursuance of clause (2);
and which may, make such order, issue such writs and give such directions as it may consider appropriate for the purpose of enforcing, or securing the enforcement of, any of the provisions of Articles 11 to 26 inclusive.

a. If in any proceedings in any subordinate court any question arises as to the contravention of any of the provisions of Articles 11 to 26 inclusive, the person presiding in that court may, and shall if any party to the proceedings so requests, refer the question to the High Court unless, in his opinion the raising of the question is merely frivolous or vexatious.
b. Any person aggrieved by any determination of the High Court under this Article may appeal therefrom to the Supreme Court:
Provided that no appeal shall lie from a determination of the High Court under this Article dismissing an application on the ground that it is frivolous and vexatious.
3. No application shall be brought under clause (1) on the grounds that the provisions of Articles 11 to 26 (inclusive) are likely to be contravened by reason of proposals contained in any bill which, at the date of the application, has not become a law.
4. Parliament may confer upon the Supreme Court or High Court such jurisdiction or powers in addition to those conferred by this Article as may appear to be necessary or desirable of the purpose of enabling that Court more effectively to exercise the jurisdiction conferred upon it by this Article or of enabling any application for redress to be more speedily determined. - EnglishAnyone whose rights as enshrined in this Constitution are violated and who, as a consequence, has suffered harm or prejudice by organs of the State, its leaders, functionaries, or employees while exercising their duties of their position or by undue oversight of these duties, as well as by individuals or by non-State entities, has the right to issue a complaint with the court to obtain restitution of their rights and, in accordance with the law, the corresponding redress or indemnity.
The law establishes the rights protected under this guarantee, and the preferential, expedited, and reduced proceedings to comply with it. The Constitutional Court, at the demand of the President of the Republic or of any member of the National Assembly, decides on the constitutionality of the laws before their promulgation.
It decides[,] of office[,] on the constitutionality of the laws and any regulatory texts which would infringe the fundamental rights of the human person and the public freedoms. It decides more generally on the violations of the rights of the human person and its decision must intervene within a time period of eight days. (Art. 121) - French
La Cour constitutionnelle, à la demande du président de la République ou de tout membre de l'Assemblée nationale, se prononce sur la constitutionnalité des lois avant leur promulgation.
Elle se prononce d'office sur la constitutionnalité des lois et de tout texte réglementaire censés porter atteinte aux droits fondamentaux de la personne humaine et aux libertés publiques. Elle statue plus généralement sur les violations des droits de la personne humaine et sa décision doit intervenir dans un délai de huit jours. (Art. 121)
