Political Parties
- English(1) Elections for the seats in Parliament provided for under Articles 97(1)(c) and 98(1)(b), (c) and (d), and for the members of county assemblies under article 177(1)(b) and (c), shall be on the basis of proportional representation by use of party lists.
(2) The Independent Electoral and Boundaries Commission shall be responsible for the conduct and supervision of elections for seats provided for under clause (1) and shall ensure that—
(a) each political party participating in a general election nominates and submits a list of all the persons who would stand elected if the party were to be entitled to all the seats provided for under clause (1), within the time prescribed by national legislation;
(b) except in the case of the seats provided for under Article 98 (1) (b), each party list comprises the appropriate number of qualified candidates and alternates between male and female candidates in the priority in which they are listed;
(c) except in the case of county assembly seats, each party list reflects the regional and ethnic diversity of the people of Kenya.

- EnglishUnder the framework [cadre] of the freedom of association recognized and guaranteed by this Constitution, the political parties, groups of political parties, trade-unions [syndicats], the non-governmental organizations and other associations or groups of associations are formed and exercise their activities freely, within respect for the laws and regulations in force.
The political parties and the groups of political parties concur in the expression of the suffrage. The same prerogatives are recognized to all Nigerien citizens enjoying their civil and political rights and meeting the conditions of eligibility provided by the law.
The political parties with an ethnic, regionalist or religious character are prohibited. No party may be knowingly created with the purpose of promoting an ethnic group, a region or a religion, under penalty of the sanctions provided by the law. (1) Persons who are committed to common political ideology, philosophy and program may, subject to laws made pursuant to sub-clause (c) of clause (2) of Article 17, form and operate political parties, and generate, or cause to be generated, publicity in order to secure support and cooperation from public-in-general for their ideology, philosophy and program or carry out other necessary activity for this purpose.
(2) A political party formed in accordance with clause (1) shall be required to be registered the party with the Election Commission upon fulfilment of the procedures as laid down by law.
(3) A petition to be filed for the purpose of registration of a party pursuant to clause (2) shall be accompanied by the constitution and manifesto of the concerned political party and such other documents as required by federal law.
(4) For a petition to be filed for the registration of a party pursuant to clause (2), the political party shall fulfil the following conditions:-
(a) Its constitution and rules shall be required be democratic;
(b) Its constitution shall provide for election of each of the officebearers of the party at the Federal and Provincial levels at least once in every five years;
Provided that nothing shall bar the making of provision in the constitution of a political party to hold such election within six months in the event of failure to hold election of its office-bearers within five years because of occurrence a special circumstance;
(c) There shall be a provision of such inclusive representation in its executive committees at various levels as may be reflecting the diversity of Nepal.
(5) In case the name, objective, insignia or flag of a political party is of such a nature as to jeopardize the religious and communal unity of the country or to fragment the country, that party shall not be registered. (Art. 269) - Nepali
(१) समान राजनीतिक विचारधारा, दर्शन र कार्यक्रममा प्रतिबद्ध व्यक्तिहरूले धारा १७ को उपधारा (२) को खण्ड (ग) अन्तर्गत बनेको कानूनको अधीनमा रही राजनीतिक दल गठन गरी सञ्चालन गर्न र दलको विचारधारा, दर्शन र कार्यक्रमप्रति जनसाधारणको समर्थन र सहयोग प्राप्त गर्नका लागि त्यसको प्रचार र प्रसार गर्न, गराउन वा सो प्रयोजनका लागि अन्य आवश्यक काम गर्न सक्नेछन् ।
(२)उपधारा (१) बमोजिम गठन भएका राजनीतिक दलले कानून बमोजिमको कार्यविधि पूरा गरी निर्वाचन आयोगमा दल दर्ता गराउनु पर्नेछ ।
(३) उपधारा (२) बमोजिम दल दर्ता गराउने प्रयोजनका लागि निवेदन पेश गर्दा सम्बन्धित राजनीतिक दलको विधान र घोषणापत्रका अतिरिक्त संघीय कानून बमोजिमका अन्य कागजात पेश गर्नु पर्नेछ ।
(४) उपधारा (२) बमोजिम दल दर्ताका लागि निवेदन दिंदा राजनीतिक दलले देहायका शर्त पूरा गर्नु पर्नेछ :–
(क) राजनीतिक दलको विधान र नियमावली लोकतान्त्रिक हुनु पर्छ,
(ख) राजनीतिक दलको विधानमा कम्तीमा पाँच वर्षमा एक पटक सो दलका संघीय र प्रदेश तहका प्रत्येक पदाधिकारीको निर्वाचन हुने व्यवस्था हुनु पर्छ,
तर विशेष परिस्थिति उत्पन्न भई पाँच वर्षभित्रमा पदाधिकारीको निर्वाचन सम्पन्न हुन नसकेमा छ महीनाभित्र त्यस्तो निर्वाचन गर्न सकिने गरी राजनीतिक दलको विधानमा व्यवस्था गर्न बाधा पर्ने छैन ।
(ग) दलको विभिन्न तहका कार्यकारिणी समितिमा नेपालको विविधतालाई प्रतिबिम्बित गर्ने गरी समावेशी प्रतिनिधित्वको व्यवस्था गरिएको हुनु पर्छ ।
(५) कुनै राजनीतिक दलको नाम, उद्देश्य, चिन्ह वा झण्डा देशको धार्मिक वा साम्प्रदायिक एकतामा खलल पार्ने वा देशलाई विखण्डित गर्ने प्रकृतिको रहेछ भने त्यस्तो राजनीतिक दल दर्ता हुने छैन । (धारा २६९)

This Constitution guarantees the free establishment and exercise of their activities, as well as their democratic organization and performance, representation of minority groups, competition for those standing as candidates for elective public positions, access to public information and communication of their ideas.
The State contributes to the economic support of their activities and the training of their leaders.

El Estado contribuye al sostenimiento económico de sus actividades y de la capacitación de sus dirigentes.

- EnglishThe activities, internal regulations and operation of political parties shall be in line with democratic principles. The application of these principles is regulated by law.
Political parties shall not engage in commercial activities.
The income and expenditure of political parties shall be consistent with their objectives. The application of this rule is regulated by law. The auditing of acquisitions, revenue and expenditure of political parties by the Constitutional Court in terms of conformity to law as well as the methods of audit and sanctions to be applied in case of inconformity to law shall be indicated in law. The Constitutional Court shall be assisted by the Court of Accounts in performing its task of auditing. The judgments rendered by the Constitutional Court because of the auditing shall be final.
