The National Elections Commission is an independent authority and shall be solely competent to administer referenda and elections of the president, the parliament and the local councils. Such administration shall include the development and updating of a database for voters, proposing the division of constituencies, determination of controls for promotion and funding of electoral campaigns, as well as electoral expenditure, the disclosure of such expenditure, the supervision of such controls, the facilitation of the procedures for out-of-country voting by expatriate Egyptians, and other procedures till the announcements of the results.
The foregoing shall be regulated by law. (Art. 208)

1. The Electoral Supervisory Commission shall have general responsibility for and shall supervise, the registration of electors for the election of members of the Assembly and the conduct of elections of such members and the Commission shall have such powers and other functions relating to such registration and such elections as may be prescribed.
2. The Electoral Commissioner shall have such powers and other functions relating to such registration and elections as may be prescribed, and he shall keep the Electoral Supervisory Commission fully informed concerning the exercise of his functions and shall have the right to attend meetings of the Commission and to refer to the Commission for their advice or decision any question relating to his functions.

(1) Independent commissions shall be established, and figures with attested competence and integrity shall be nominated therefor. They are formed and their competencies defined by the laws that establish them.

The independent national authority of elections is an independent institution. (Art. 200)

(1) Subject to the provisions of this Constitution the Independent Electoral Commission shall be responsible for
(a) the conduct and supervision of the registration of voters for all public elections and the conduct and supervision of all public elections and referenda;

The national commissions, specialised organs and national councils entrusted with the responsibility to help in resolving important issues facing the country are the following:
1° national commissions:

d) National Electoral Commission;

Specific laws determine the mission, organisation and functioning of these institutions.

1. There is established the Electoral Commission of Zambia which shall have offices in Provinces and progressively in districts.
2. The Electoral Commission shall—
a. implement the electoral process;
b. conduct elections and referenda;
c. register voters;
d. settle minor electoral disputes, as prescribed;
e. regulate the conduct of voters and candidates;
f. accredit observers and election agents, as prescribed;
g. delimit electoral boundaries; and
h. perform such other functions as prescribed. (Art. 229)

The Commission is responsible for the following missions:
a) To organize the elections at the national level, at the level of the communes and at that of the collines or of the quartiers;
b) To see to it that the elections are free, regular and transparent;
c) To proclaim the provisional results of the elections within a time period defined by the law;
d) To promulgate the arrangements, the code of conduct and the technical details, including the location of the polls [bureaux de vote] and the hours in which they are open;
e) To receive the claims concerning the respect for the electoral rules and to process them [y donner suite];
f) The decisions of the Commission are without appeal;
g) To see to it, applying the appropriate rules, that the electoral campaigns do not take place [se déroulent] in a manner that incites to ethnic violence or in any other manner contrary to this Constitution;
h) To assure the respect for the provisions of this Constitution relative to multiethnicity and to gender[,] and to take cognizance of the claims in this respect. (Art. 92)

(1) Elections for the seats in Parliament provided for under Articles 97(1)(c) and 98(1)(b), (c) and (d), and for the members of county assemblies under article 177(1)(b) and (c), shall be on the basis of proportional representation by use of party lists.
(2) The Independent Electoral and Boundaries Commission shall be responsible for the conduct and supervision of elections for seats provided for under clause (1) and shall ensure that—
(a) each political party participating in a general election nominates and submits a list of all the persons who would stand elected if the party were to be entitled to all the seats provided for under clause (1), within the time prescribed by national legislation;
(b) except in the case of the seats provided for under Article 98 (1) (b), each party list comprises the appropriate number of qualified candidates and alternates between male and female candidates in the priority in which they are listed;
(c) except in the case of county assembly seats, each party list reflects the regional and ethnic diversity of the people of Kenya.

Subject to the provisions of this Constitution, the Electoral Commission shall be responsible for the conduct and supervision of the registration of voters for, and of, all public elections and referenda; and for that purpose shall have power to make regulations by statutory instrument for the registration of voters, the conduct of Presidential, Parliamentary or Local Government elections and referenda, and other matters connected therewith, including regulations for voting by proxy.
