(3) It shall be the duty of the Electoral Commission to suspend the election, either in all electoral divisions or in any one or more of such divisions, if it has reasonable ground to believe that illegal or corrupt practices or other offences connected with the elections have been committed or there has been foreign interference and such practices, offences or interference have so extensively prevailed or have been of such nature that they may reasonably be expected to affect the result of the election, in all or in any one or more of the electoral divisions.

A supreme committee that enjoys independence and impartiality, chaired by a deputy chairman of the Supreme Court, shall be responsible for overseeing the election of the members of Majlis Al-Shura and for ruling on election petitions. The Commission shall have power to –
(a) organise, undertake and supervise all elections to the offices of the President and Vice-President, the Governor and Deputy Governor of a State, and to the membership of the Senate, the House of Representatives and the House of Assembly of each State of the Federation;
(b) register political parties in accordance with the provisions of this Constitution and an Act of the National Assembly;
(c) monitor the organisation and operation of the political parties, including their finances, conventions, congresses and party primaries;
(d) arrange for the annual examination and auditing of the funds and accounts of political parties, and publish a report on such examination and audit for public information;
(e) arrange and conduct the registration of persons qualified to vote and prepare, maintain and revise the register of voters for the purpose of any election under this Constitution;
(f) monitor political campaigns and provide rules and regulations which shall govern the political parties;
(g) ensure that all Electoral Commissioners, Electoral and Returning Officers take and subscribe the Oath of Office prescribed by law;
(h) delegate any of its powers to any Resident Electoral Commissioner; and
(i) carry out such other functions as may be conferred upon it by an Act of the National Assembly. (Third Schedule, Sec. 15)

b. to organise, conduct and supervise elections and referenda in accordance with this Constitution;

e. to compile, maintain, revise and update the voters' register;

- EnglishThe National Electoral Council shall regulate, inspect, monitor and control all the electoral activities of the Political Parties and Movements, of the significant groups of citizens, of their legal representatives, directors and candidates, guaranteeing compliance with the principles and duties that correspond to them and shall enjoy budgetary and administrative autonomy. It will have the following special attributions:
1. To exercise the supreme inspection, oversight and control of the electoral organization.
2. To habilitate the National Registrar of Civil Status.
3. To take cognizance of and decide definitively the recourses that are interposed against the decisions of its delegates concerning general ballots and in such cases to make the declaration of election and issue the corresponding credentials.
4. Furthermore, of office, or on request, to review ballots and the electoral documents concerning any of the stages of the administrative process of election with the object of guaranteeing the veracity of the results.
5. To serve as [a] consultative body of the Government concerning matters of its competence, to present Bills of Legislative Acts and of law, and to recommend drafts [proyectos] of decree[s].
6. To see to compliance with the norms concerning [the] Political Parties and Movements and the provisions concerning publicity and political opinion polls; for the rights of the opposition and of the minorities, and for the development of the electoral processes in conditions of full guarantees.
7. To distribute the contributions that[,] for the financing of the electoral campaigns and to assure the right of political participation of the citizens, are established by the law.
8. To effect the ballot of all national voting, to make the declaration of the elections and to issue the credentials that may arise.
9. To recognize and revoke the Juridical Personality[,] of the Political Parties and Movements.
10. To regulate the participation of the Political Parties and Movements in the media of social communication of the State.
11. To collaborate for the holding of the consultations of the parties and movements for making decisions and the choosing of their candidates.
12. To decide on the revocation of the registration of candidates for Public Corporations or offices [cargos] of popular election, when full evidence exists that these have incurred a cause of disqualification specified in the Constitution and the law. In no case shall the election of such candidates be declared.
13. To establish its own regulations.

Tendrá las siguientes atribuciones especiales:
1. Ejercer la suprema inspección, vigilancia y control de la organización electoral.
2. Dar posesión de su cargo al Registrador Nacional del Estado Civil.
3. Conocer y decidir definitivamente los recursos que se interpongan contra las decisiones de sus delegados sobre escrutinios generales y en tales casos hacer la declaratoria de elección y expedir las credenciales correspondientes.
4. Además, de oficio, o por solicitud, revisar escrutinios y los documentos electorales concernientes a cualquiera de las etapas del proceso administrativo de elección con el objeto de que se garantice la verdad de los resultados.
5. Servir de cuerpo consultivo del Gobierno en materias de su competencia, presentar proyectos de acto legislativo y de ley, y recomendar proyectos de decreto.
6. Velar por el cumplimiento de las normas sobre Partidos y Movimientos Políticos y de las disposiciones sobre publicidad y encuestas de opinión política; por los derechos de la oposición y de las minorías, y por el desarrollo de los procesos electorales en condiciones de plenas garantías.
7. Distribuir los aportes que para el financiamiento de las campañas electorales y para asegurar el derecho de participación política de los ciudadanos, establezca la ley.
8. Efectuar el escrutinio general de toda votación nacional, hacer la declaratoria de elección y expedir las credenciales a que haya lugar.
9. Reconocer y revocar la Personería Jurídica de los partidos y movimientos políticos.
10. Reglamentar la participación de los Partidos y Movimientos Políticos en los medios de comunicación social del Estado.
11. Colaborar para la realización de consultas de los partidos y movimientos para la toma de decisiones y la escogencia de sus candidatos.
12. Decidir la revocatoria de la inscripción de candidatos a Corporaciones Públicas o cargos de elección popular, cuando exista plena prueba de que aquellos están incursos en causal de inhabilidad prevista en la Constitución y la ley. En ningún caso podrá declarar la elección de dichos candidatos.
13. Darse su propio reglamento.

- EnglishIn addition to the functions conferred upon it by law, the Electoral Tribunal shall have the following functions which it shall exercise solely, with the exception of those mentioned in numerals 5 and 7:
1. To record births, marriages, deaths, naturalizations, and the other facts and legal acts related to the civil status of persons, and to include the necessary explanatory notes in the respective records;
2. To issue personal identity cards;
3. To regulate, interpret and apply the Electoral Law and to decide on disputes caused by its application;
4. To punish offenses and crimes against free and fair elections in accordance with law, granting a second instance;
5. To keep the electoral register;
6. To organize, direct and supervise the registration of voters, and to resolve disputes, applications and complaints that may arise in this respect;
7. To process the records of immigration and naturalization applications;
8. To name the members of the Electoral Boards on which the representation of the legally established political parties must be guaranteed. The law shall regulate this matter;
9. To draft its budget and to present it in a timely manner to the Executive Branch for inclusion in the draft General Budget of the State. The Electoral Tribunal shall defend, at all stages, its draft budget. The finally approved budget shall provide it with the necessary funds for the fulfillment of its functions. In the budget shall be included the operating costs of the Electoral Tribunal and of the Office of the Electoral Prosecutor, the investments and costs needed for the conduct of the election processes and other popular consultations as well as the subsidies to the political parties and the independent candidates for elected office. In the year immediately prior to the general elections and until the end of the electoral period the Tribunal Electoral shall be subject only to posterior supervision by the Office of the Comptroller General;
10. To initiate legislation on matters within its jurisdiction;
11. To consider as the sole competent body the applications and actions brought against the decisions of the lower electoral criminal tribunals and the Office of the Electoral Prosecutor.
… (Art. 143) - SpanishEl Tribunal Electoral tendrá, además de las que le confiere la Ley, las siguientes atribuciones que ejercerá privativamente, excepto las consignadas en los numerales 5, 7 y 10:
1. Efectuar las inscripciones de nacimientos, matrimonios, defunciones, naturalizaciones y demás hechos y actos jurídicos relacionados con el estado civil de las personas, y hacer las anotaciones procedentes en las respectivas inscripciones.
2. Expedir la cédula de identidad personal.
3. Reglamentar la Ley Electoral, interpretarla y aplicarla, y conocer de las controversias que origine su aplicación.

8. Nombrar los miembros de las corporaciones electorales, en las cuales se deberá garantizar la representación de los partidos políticos legalmente constituidos. La Ley reglamentará esta materia.
9. Formular su presupuesto y remitirlo oportunamente al Órgano Ejecutivo para su inclusión en el proyecto de Presupuesto General del Estado. El Tribunal Electoral sustentará, en todas las etapas, su proyecto de presupuesto. El presupuesto finalmente aprobado procurará garantizarle los fondos necesarios para el cumplimiento de sus fines. En dicho presupuesto se incorporarán los gastos de funcionamiento del Tribunal Electoral y de la Fiscalía General Electoral, las inversiones y los gastos necesarios para realizar los procesos electorales y las demás consultas populares, así como los subsidios a los partidos políticos y a los candidatos independientes a los puestos de elección popular. Durante el año inmediatamente anterior a las elecciones generales y hasta el cierre del periodo electoral, el Tribunal Electoral será fiscalizado por la Contraloría General de la República, solamente mediante el control posterior.

- English1. The Central Electoral Commission is an independent state body, which shall organize the elections of the National Assembly and local self-government bodies, as well as referenda, and shall supervise their lawfulness.
2. In the cases and manner stipulated by law, the Central Electoral Commission shall adopt sub-legislative normative legal acts.
3. The Central Electoral Commission shall present a communication about its activities to the National Assembly.

- English(1) The Commission shall exercise, perform and discharge all such powers, duties and functions conferred or imposed on or assigned to –
(a) the Commission; or
(b) the Commissioner-General of Elections,
by the Constitution, and by the law for the time being relating to the election of the President, the election of Members of Parliament, the election of members of Provincial Councils, the election of members of Local Authorities and the conduct of Referenda, including but not limited to all the powers, duties and functions relating to the preparation and revision of registers of electors for the purposes of such elections and Referenda and the conduct of such elections and Referenda.
(2) It shall be the duty of the Commission to secure the enforcement of all laws relating to the holding of any such election or the conduct of Referenda and it shall be the duty of all authorities of the State charged with the enforcement of such laws, to co-operate with the Commission to secure such enforcement.
