(a) having been requested by the people of Papua New Guinea, through their Constituent Assembly, to become the Queen and Head of State of Papua New Guinea; and
(b) having graciously consented so to become, is the Queen and Head of State of Papua New Guinea.
(2) Subject to and in accordance with this Constitution, the privileges, powers, functions, duties and responsibilities of the Head of State may be had, exercised and performed through a Governor-General appointed in accordance with Division 3 (appointment, etc., of Governor-General) and, except where the contrary intention appears, reference in any law to the Head of State shall be read accordingly. Head of State
- English(1) Any reference in this Constitution to the functions of the Governor General shall be construed as a reference to his or her powers and duties in the exercise of the executive authority of Saint Lucia and to any other powers and duties conferred or imposed on him or her as Governor General by or under this Constitution or any other law.
(2) Where by this Constitution the Governor General is required to perform any function after consultation with any person or authority he or she shall not be obliged to exercise that function in accordance with the advice of that person or authority.
(3) Where by this Constitution the Governor General is required to perform any function in accordance with the advice of, or after consultation with, any person or authority, the question whether the Governor General has so exercised that function shall not be enquired into in any court of law. (1) The Federal President shall be elected by the federal people on the basis of equal, direct, personal, free and secret suffrage by men and women having suffrage to the National Council. If only one candidate stands for election, it shall be carried out in form of a voting. Art. 26 para 5 to 7 shall apply accordingly.
(2) The candidate who polls more than half of all valid votes has been elected. If no such majority results, a second ballot takes place. Votes in this can validly be cast only for one of the two candidates who have polled the most votes in the first ballot.
(3) Only a person who is eligible for election to the National Council and has completed the thirty-fifth year of life on the day of the election can be elected Federal President.

(1) Der Bundespräsident wird vom Bundesvolk auf Grund des gleichen, unmittelbaren, persönlichen, freien und geheimen Wahlrechtes der zum Nationalrat wahlberechtigten Männer und Frauen gewählt; stellt sich nur ein Wahlwerber der Wahl, so ist die Wahl in Form einer Abstimmung durchzuführen. - EnglishThe constitutional powers of the King are hereditary through the direct, natural and legitimate descent from H.M. Leopold, George, Christian, Frederick of Saxe-Coburg, by order of primogeniture.
The descendant mentioned in the first paragraph who marries without the King’s consent or, in his absence, without the consent of those exercising the King’s powers in cases provided for by the Constitution shall be deprived of his right to the crown.
Nonetheless, this right may be restored by the King or, in his absence, by those exercising the powers of the King in cases provided for by the Constitution, but only with the assent of both Houses. (1) Whenever the office of President is vacant, or if the term of office of the President is due to expire within not more than ninety days, the Prime Minister shall consult with the Leader of the Opposition with a view to their joint nomination of a candidate for election as President.
(2) If the Prime Minister and the Leader of the Opposition make in writing to the Speaker a joint nomination of a qualified candidate for election as President, being a nomination to which that candidate has consented, the Speaker shall notify both Houses of the joint nomination and, at a joint meeting of both Houses, shall ask the members whether any member has an objection to the candidate being declared duly elected, if no member objects thereto, the Speaker shall declare the candidate duly elected.
(3) If there is an objection under subsection (2) the Speaker shall not declare the candidate duly elected but shall suspend the joint meeting.
(4) The members of each House shall, immediately following the suspension, resume in their respective House and the presiding officer of each House shall put the question referred to in subsection (2) to a vote.
(5) Immediately upon announcing the result of the vote in each House, the joint sitting shall resume and the President of the Senate and the Speaker shall each announce the result of the vote.
(6) If the candidate receives not less than two-thirds of the votes cast in each House, the Speaker shall then declare the candidate duly elected.
