- English1. The Head of State shall be appointed by the Legislative Assembly acting on the recommendation of the party or parties in Government.
2. A person shall not be qualified to be appointed to the office of Head of State
a. if he is not a person qualified to be elected as a Member of Parliament; or
b. if he does not possess such other qualifications as the Legislative Assembly may determine from time to time by resolution; or

The provisions of this Constitution referring to the Sovereign extend, in accordance with section 13 (references to the Sovereign of Tuvalu) of Schedule 1, to the Heirs and Successors of the Sovereign according to law. (Sec. 50)

- English(1) Except in the case of the first Governor-General appointed before Independence Day the Governor-General shall be appointed by the Head of State, acting with, and in accordance with, the advice of the National Executive Council given in accordance with a decision of the Parliament.
