- English(1) Where there is occasion for the appointment of a Prime Minister, the President shall appoint as Prime Minister—
(a) a member of the House of Representatives who is the Leader in that House of the party which commands the support of the majority of members of that House; or
(b) where it appears to him that that party does not have an undisputed leader in that House or that no party commands the support of such a majority, the member of the House of Representatives who, in his judgment, is most likely to command the support of the majority of members of that House, and who is willing to accept the office of Prime Minister.

(3) The Ministers other than the Prime Minister shall be such persons as the President, acting in accordance with the advice of the Prime Minister, shall appoint from among the members of the House of Representatives and the Senators.

- English(1) There shall be a Prime Minister who shall be elected as such by the members of Parliament from amongst their number in accordance with the provisions of Schedule 2 to this Constitution.
(2) There shall be, in addition to the office of Prime Minister, such other offices of Minister of the Government, not exceeding eleven or such greater number as Parliament may prescribe, as may be established by the Governor General, acting in accordance with the advice of the Prime Minister. Provided that one of such offices of Minister of the Government shall be that of Deputy Prime Minister.
(3) The Ministers other than the Prime Minister shall be appointed by the Governor-General, acting in accordance with the advice of the Prime Minister, from among the members of Parliament: Provided that if occasion arises for making an appointment while Parliament is dissolved a person who was a member of Parliament immediately before the dissolution may be appointed. - English(1) The Prime Minister and members of the Cabinet meet the following conditions:
(a) He is Sudanese by birth;
(b) He is not be less than 25 years of age;
(c) Fairness, competence, qualification, and he has the practical expertise and the appropriate administrative capabilities for the position;
(d) He has not been convicted by a final ruling from a competent court of a crime of honor, trustworthiness or financial responsibility;
(2) Subject to the condition found in Paragraph (1-a) of this article, the Prime Minister and the Ministers of Defense, Interior, Foreign Affairs, and Justice shall not bear the nationality of another country. Exemptions from this condition may be granted by agreement between the Sovereignty Council and the Forces of Freedom and Change for the Prime Minister, and by agreement between the Sovereignty Council and the Prime Minister with respect to the ministers mentioned in this paragraph. 2. مع مراعاة الشرط الواردفي الفقره (1ا) من هذة ماده، يشترط في اي من رئيس الوزراء ووزراء الدفاع، الداخلية، الخارجية والعدل الا يحمل جنسية دولة اخري، ويجوز الاستثناء من هذا الشرط بالتوافق بين مجلس السيادة و قوي اعلان الحرية والتغيير لرئيس الوزراء، والتوافق بين مجلس السيادة ورئيس الوزراء بالنسبة للوزراء المزكورين في هذة الفقرة.
