- English(1) There shall be a Prime Minister who shall be elected as such by the members of Parliament from amongst their number in accordance with the provisions of Schedule 2 to this Constitution.

- English(1) The Prime Minister and members of the Cabinet meet the following conditions:
(a) He is Sudanese by birth;
(b) He is not be less than 25 years of age;
(c) Fairness, competence, qualification, and he has the practical expertise and the appropriate administrative capabilities for the position;
(d) He has not been convicted by a final ruling from a competent court of a crime of honor, trustworthiness or financial responsibility;
(2) Subject to the condition found in Paragraph (1-a) of this article, the Prime Minister and the Ministers of Defense, Interior, Foreign Affairs, and Justice shall not bear the nationality of another country. Exemptions from this condition may be granted by agreement between the Sovereignty Council and the Forces of Freedom and Change for the Prime Minister, and by agreement between the Sovereignty Council and the Prime Minister with respect to the ministers mentioned in this paragraph. ا. ان يكون سودانياً بالميلاد.
ب. الا يقل عمره من خمسة وعشرون عاماً.
ج. ان يكون من ذوي النزاهة والكفاءة والتأهيل الخبره العملية والقدرات الإدارية الملائمة للمنصب.
د. الا يكون قد ادين بحكم نهائي من محكمة مختصة في جريمة تتعلق بالشرف او الامانة او الذمة المالية.
2. مع مراعاة الشرط الواردفي الفقره (1ا) من هذة ماده، يشترط في اي من رئيس الوزراء ووزراء الدفاع، الداخلية، الخارجية والعدل الا يحمل جنسية دولة اخري، ويجوز الاستثناء من هذا الشرط بالتوافق بين مجلس السيادة و قوي اعلان الحرية والتغيير لرئيس الوزراء، والتوافق بين مجلس السيادة ورئيس الوزراء بالنسبة للوزراء المزكورين في هذة الفقرة.
