- English1. Subject to the provisions of subsections (4) and (5) no law shall make any provision that is discriminatory either of itself or in its effect.

4. Subsection (1) shall not apply to any law to the extent that that law makes provision—

- EnglishThe customary and traditional rules governing the matrimonial regimes and inheritance may only be applicable with the consent of the parties concerned.

- English(1) INgwenyama is the traditional head of the Swazi State and is chosen by virtue of the rank and character of his mother in accordance with Swazi law and custom.
(2) INgwenyama enjoys the same legal protection and immunity from legal suit or process as the King.

e. the common law.
(2) The common law of Sierra Leone shall comprise the rules of law generally known as the common law, the rules of law generally known as the doctrines of equity, and the rules of customary law including those determined by the Superior Court of Judicature.
(3) For the purposes of this section the expression “customary law” means the rules of law which by custom are applicable to particular communities in Sierra Leone.

- EnglishThe State recognizes the traditional leadership [chefferie] as the depositary of customary authority. As such, it participates in the administration of the territory of the Republic in the conditions determined by the law.
The traditional leadership is held to a strict obligation of neutrality and reserve. It is protected against any abuse of power tending to divert it from the role conferred on it by the law. (Art. 167) - FrenchL’Etat reconnaît la chefferie traditionnelle comme dépositaire de l’autorité coutumière. A ce titre, elle participe à l’administration du territoire de la République dans les conditions déterminées par la loi.
La chefferie traditionnelle est tenue à une stricte obligation de neutralité et de réserve. Elle est protégée contre tout abus de pouvoir tendant à la détourner du rôle que lui confère la loi. (Art. 167)

(a) be members of any political party or in any way participate in partisan politics;

- English1. A regional assembly may establish standing and other committees or organs for the efficient discharge of its functions.
2. The representatives of cultural interests shall constitute the standing committee on cultural matters.
3. The standing committee on cultural matters shall have, as against the rest of the members of the regional assembly, exclusive jurisdiction on the cultural matters of the region.
4. In this paragraph "cultural matters" include the following-
a. the choice and installation of a traditional leader or cultural leader;
b. all traditional and cultural matters relating to the traditional or cultural leader and to the institutions of the traditional leader or cultural leader as well as royal members of the traditional leadership;
c. the choice, appointment and succession to clan and subclan leadership;
d. clan, traditional and customary matters;
e. matters relating to cultural funeral rites, cultural succession and customary heirs;
f. cultural or traditional lands, sites, shrines and installations;
g. clan lands, sites, shrines and installations; and
h. traditional, customary and cultural practices which are consistent with this Constitution.
5. In carrying out its responsibilities under subparagraphs (3) and (4), the standing committee on cultural matters shall consult the traditional or cultural leader of the region as well as the relevant clan leaders.
6. A decision of the standing committee on cultural matters shall not be effective until the decision has been approved by the traditional or cultural leader of the region and, in the case of succession under subparagraph (4)(a), by the clan or cultural leader's council. - English(1) The institution of chieftaincy, together with its traditional councils as established by customary law and usage, is hereby guaranteed.
(2) Parliament shall have no power to enact any law which—
(a) confers on any person or authority the right to accord or withdraw recognition to or from a chief for any purpose whatsoever; or
(b) in any way detracts or derogates from the honour and dignity of the institution of chieftaincy.
(3) Nothing in or done under the authority of any law shall be held to be inconsistent with, or in contravention of, clause (1) or (2) of this article if the law makes provision for—
(a) the determination, in accordance with the appropriate customary law and usage, by a traditional council, a Regional House of Chiefs or the National House of Chiefs or a Chieftaincy Committee of any of them, of the validity of the nomination, election, selection, installation or deposition of a person as a chief;
(b) a traditional council or a Regional House of Chiefs or the National House of Chiefs to establish and operate a procedure for the registration of chiefs and the public notification in the Gazette or otherwise of the status of persons as chiefs in Ghana. (Art. 270)
