- EnglishWhen a judge, by virtue of his/her office or at the request of a party, considers that a legal norm is contrary to the Constitution or to international human rights instruments that provide for rights that are more favorable than those enshrined in the Constitution, it shall suspend the case and refer it for consultation to the Constitutional Court, which within no more than forty-five (45) days shall rule on the constitutionality of the norm.
If the Court issues no ruling within the established time-limits, the affected party is entitled to file the corresponding complaint. (Art. 428) - SpanishCuando una jueza o juez, de oficio o a petición de parte, considere que una norma jurídica es contraria a la Constitución o a los instrumentos internacionales de derechos humanos que establezcan derechos más favorables que los reconocidos en la Constitución, suspenderá la tramitación de la causa y remitirá en consulta el expediente a la Corte Constitucional, que en un plazo no mayor a cuarenta y cinco días, resolverá sobre la constitucionalidad de la norma.

For ruling on the admissibility of this appeal, the court shall check compliance with the following requirements:
1. That the judgments, writs and resolutions are final and fully enforceable.
2. That the complainant shows that, in the judgment, there has been a breach, either by deed or omission, of due process of law or other rights enshrined in the Constitution. - EnglishThe Constitutional Court shall perform the following duties, in addition to those granted to it by the law:
1. To be the supreme body for interpreting the Constitution and international human rights treaties ratified by the Ecuadorian State by its rulings and judgments. Its decisions shall be binding.
2. To hear and resolve public claims of unconstitutionality, based either on substantive or procedural grounds, filed against general regulatory acts issued by authorities of the State. The declaration of unconstitutionality shall lead to invalidation of the challenged regulatory act.
3. To declare, by virtue of its office, unconstitutional those norms that are related, when in those cases submitted to its examination it concludes that one or various of them are contrary to the Constitution.
4. To hear and resolve, at the request of a party, claims of unconstitutionality against general administrative acts issued by all public authorities. The declaration of unconstitutionality shall lead to the invalidity of the challenged administrative act.
5. To hear and resolve, at the request of the party, claims of noncompliance that are filed to guarantee enforcement of general administrative regulations or acts, regardless of their nature or hierarchy, as well for enforcement of rulings or reports from international organizations for the protection of human rights that are not enforceable through regular judiciary channels.
6. To issue judgments that constitute binding case law with respect to actions of protection, enforcement, habeas corpus, habeas data, access to public information and other constitutional processes, as well as those cases selected by the Court for review.
7. To arbitrate conflicts of jurisdictions or attributions among the branches of government or bodies established by the Constitution.
8. To ensure, by virtue of its office and immediately, monitoring of the constitutionality of the declarations of state of emergency, when this involves the suspension of constitutional rights.
9. To hear and sanction failure to comply constitutional rulings and decisions.
10. To declare the unconstitutionality incurred by State institutions or public authorities that fail to observe, either totally or partially, the mandates contained in constitutional norms, within the time-limits set by the Constitution or within the time-limits deemed to be reasonable by the Constitutional Court. If this failure persists, after this time-limit has elapsed, the Court shall provisionally issue the regulation or enforce the observance, in accordance with the law. (Art. 436) - SpanishLa Corte Constitucional ejercerá, además de las que le confiera la ley, las siguientes atribuciones:
1. Ser la máxima instancia de interpretación de la Constitución, de los tratados internacionales de derechos humanos ratificados por el Estado ecuatoriano, a través de sus dictámenes y sentencias. Sus decisiones tendrán carácter vinculante.
2. Conocer y resolver las acciones públicas de inconstitucionalidad, por el fondo o por la forma, contra actos normativos de carácter general emitidos por órganos autoridades del Estado.
La declaratoria de inconstitucionalidad tendrá como efecto la invalidez del acto normativo impugnado.
3. Declarar de oficio la inconstitucionalidad de normas conexas, cuando en los casos sometidos a su conocimiento concluya que una o varias de ellas son contrarias a la Constitución.
4. Conocer y resolver, a petición de parte, la inconstitucionalidad contra los actos administrativos con efectos generales emitidos por toda autoridad pública. La declaratoria de inconstitucionalidad tendrá como efecto la invalidez del acto administrativo.
5. Conocer y resolver, a petición de parte, las acciones por incumplimiento que se presenten con la finalidad de garantizar la aplicación de normas o actos administrativos de carácter general, cualquiera que sea su naturaleza o jerarquía, así como para el cumplimiento de sentencias o informes de organismos internacionales de protección de derechos humanos que no sean ejecutables por las vías judiciales ordinarias.
6. Expedir sentencias que constituyan jurisprudencia vinculante respecto de las acciones de protección, cumplimiento, hábeas corpus, hábeas data, acceso a la información pública y demás procesos constitucionales, así como los casos seleccionados por la Corte para su revisión.
7. Dirimir conflictos de competencias o de atribuciones entre funciones del Estado u órganos establecidos en la Constitución.
8. Efectuar de oficio y de modo inmediato el control de constitucionalidad de las declaratorias de los estados de excepción, cuando impliquen la suspensión de derechos constitucionales.
9. Conocer y sancionar el incumplimiento de las sentencias y dictámenes constitucionales.
10. Declarar la inconstitucionalidad en que incurran las instituciones del Estado o autoridades públicas que por omisión inobserven, en forma total o parcial, los mandatos contenidos en normas constitucionales, dentro del plazo establecido en la Constitución o en el plazo considerado razonable por la Corte Constitucional. Si transcurrido el plazo la omisión persiste, la Corte, de manera provisional, expedirá la norma o ejecutará el acto omitido, de acuerdo con la ley. (Art. 436)

The decisions related to the attributions provided for in the Constitution shall be adopted by the plenary of the Court. (Art. 429) - SpanishLa Corte Constitucional es el máximo órgano de control, interpretación constitucional y de administración de justicia en esta materia. Ejerce jurisdicción nacional y su sede es la ciudad de Quito.
Las decisiones relacionadas con las atribuciones previstas en la Constitución serán adoptadas por el pleno de la Corte. (Art. 429)
Obligations of the State

- EnglishThe exercise of rights shall be governed by the following principles:
1. Rights can be exercised, promoted and enforced individually or collectively before competent authorities; these authorities shall guarantee their enforcement.
2. All persons are equal and shall enjoy the same rights, duties and opportunities.
…
3. The rights and guarantees set forth in the Constitution and in international human rights instruments shall be directly and immediately enforced by and before any civil, administrative or judicial servant, either by virtue of their office or at the request of the party.
For the exercise of rights and constitutional guarantees, no conditions or requirements shall be established other than those set forth in the Constitution or by law. Rights shall be fully actionable. Absence of a legal regulatory framework cannot be alleged to justify their infringement or ignorance thereof, to dismiss proceedings filed as a result of these actions or to deny their recognition.
4. No legal regulation can restrict the contents of rights or constitutional guarantees.
5. In terms of rights and constitutional guarantees, public, administrative or judicial servants must abide by the most favorable interpretation of their effective force.
6. All principles and rights are unalienable, obligatory, indivisible, interdependent and of equal importance.
7. Recognition of the rights and guarantees set forth in the Constitution and in international human rights instruments shall not exclude the other rights stemming from the dignity of persons, communities, peoples and nations that might be needed for their full development.
8. The contents of rights shall be developed progressively by means of standards, case law, and public policies. The State shall generate and guarantee the conditions needed for their full recognition and exercise.
Any deed or omission of a regressive nature that diminishes, undermines or annuls without justification the exercise of rights shall be deemed unconstitutional.
9. The State’s supreme duty consists of respecting and enforcing respect for the rights guaranteed in the Constitution.
The State, its delegates, concession holders and all persons acting in the exercise of public authority, shall be obligated to redress infringements of the rights of individuals for negligence or inadequacies in the provision of public services or for the deeds or omissions of their public officials and employees in the performance of their duties.
The State shall immediately exercise the right to file a claim for restoration against those persons responsible for the damage produced, without detriment to civil, criminal and administrative liabilities.
The State shall be held liable for arbitrary arrest and detention, miscarriage of justice, unjustified delay or inadequate administration of justice, violation of the right to effective protection of the court, and any violations of the principles and rules of due process of law.
When a final judgment of conviction is reversed or vacated, the State shall provide redress to the person who has sustained damages as a result of this judgment; when the responsibility for such acts by public, administrative or judicial servants is identified, they shall be duly charged to obtain restitution. (Art. 11) - SpanishEI ejercicio de los derechos se regirá por los siguientes principios:
1. Los derechos se podrán ejercer, promover y exigir de forma individual o colectiva ante las autoridades competentes; estas autoridades garantizarán su cumplimiento.
2. Todas las personas son iguales y gozarán de los mismos derechos, deberes y oportunidades.

3. Los derechos y garantías establecidos en la Constitución y en los instrumentos internacionales de derechos humanos serán de directa e inmediata aplicación por y ante cualquier servidora o servidor público, administrativo o judicial, de oficio o a petición de parte.
Para el ejercicio de los derechos y las garantías constitucionales no se exigirán condiciones o requisitos que no estén establecidos en la Constitución o la ley.
Los derechos serán plenamente justiciables. No podrá alegarse falta de norma jurídica para justificar su violación o desconocimiento, para desechar la acción por esos hechos ni para negar su reconocimiento.
4. Ninguna norma jurídica podrá restringir el contenido de los derechos ni de las garantías constitucionales.
5. En materia de derechos y garantías constitucionales, las servidoras y servidores públicos, administrativos o judiciales, deberán aplicar la norma y la interpretación que más favorezcan su efectiva vigencia.
6. Todos los principios y los derechos son inalienables, irrenunciables, indivisibles, interdependientes y de igual jerarquía.
7. El reconocimiento de los derechos y garantías establecidos en la Constitución y en los instrumentos internacionales de derechos humanos, no excluirá los demás derechos derivados de la dignidad de las personas, comunidades, pueblos y nacionalidades, que sean necesarios para su pleno desenvolvimiento.
8. El contenido de los derechos se desarrollará de manera progresiva a través de las normas, la jurisprudencia y las políticas públicas. El Estado generará y garantizará las condiciones necesarias para su pleno reconocimiento y ejercicio.
Será inconstitucional cualquier acción u omisión de carácter regresivo que disminuya, menoscabe o anule injustificadamente el ejercicio de los derechos.
9. El más alto deber del Estado consiste en respetar y hacer respetar los derechos garantizados en la Constitución.
El Estado, sus delegatarios, concesionarios y toda persona que actúe en ejercicio de una potestad pública, estarán obligados a reparar las violaciones a los derechos de los particulares por la falta o deficiencia en la prestación de los servicios públicos, o por las acciones u omisiones de sus funcionarias y funcionarios, y empleadas y empleados públicos en el desempeño de sus cargos.
El Estado ejercerá de forma inmediata el derecho de repetición en contra de las personas responsables del daño producido, sin perjuicio de las responsabilidades civiles, penales y administrativas.
El Estado será responsable por detención arbitraria, error judicial, retardo injustificado o inadecuada administración de justicia, violación del derecho a la tutela judicial efectiva, y por las violaciones de los principios y reglas del debido proceso.
Cuando una sentencia condenatoria sea reformada o revocada, el Estado reparará a la persona que haya sufrido pena como resultado de tal sentencia y, declarada la responsabilidad por tales actos de servidoras o servidores públicos, administrativos o judiciales, se repetirá en contra de ellos. (Art. 11)
