The statute specifying the scope of limitation of the freedoms and rights of persons and citizens in times of martial law and states of emergency shall not limit the freedoms and rights specified in Article 30 (the dignity of the person), Article 34 and Article 36 (citizenship), Article 38 (protection of life), Article 39, Article 40 and Article 41, para.4 (humane treatment), Article 42 (ascription of criminal responsibility), Article 45 (access to a court), Article 47 (personal rights), Article 53 (conscience and religion), Article 63 (petitions), as well as Article 48 and Article 72 (family and children).
2. Limitation of the freedoms and rights of persons and citizens only by reason of race, gender, language, faith or lack of it, social origin, ancestry or property shall be prohibited.
3. The statute specifying the scope of limitation of the freedoms and rights of persons and citizens during states of natural disasters may limit the freedoms and rights specified in Article 22 (freedom of economic activity), Article 41, paras. 1, 3 and 5 (personal freedom), Article 50 (inviolability of the home), Article 52, para. 1 (freedom of movement and sojourn on the territory of the Republic of Poland), Article 59, para. 3 (the right to strike), Article 64 (the right of ownership), Article 65, para. 1 (freedom to work), Article 66, para. 1 (the right to safe and hygienic conditions of work) as well as Article 66, para. 2 (the right to rest). The freedoms and rights of the individual and citizen can be restricted during states of war or emergency, in accordance with the provisions of the Constitution. The restriction of freedoms and rights cannot discriminate on grounds of sex, race, colour of skin, language, religion, national or social origin, property or social status. The restriction of freedoms and rights cannot be applied to the right to life, the interdiction of torture, inhuman and humiliating conduct and punishment, the legal determination of punishable offences and sentences, as well as to the freedom of personal conviction, conscience, thought, public expression of thought, and religious confession. - EnglishAll persons have the right to an action of amparo in order to demand before the courts, for themselves or by those who act in their name, immediate protection of their fundamental rights, not protected by habeas corpus, when they are violated or threatened by the action or omission of any public authority or of individuals, in order put into effect the fulfillment of a law or administrative act and in order to guarantee collective and diffuse rights and interests. In accordance with the law, the proceeding is preferential, summary, oral, public, free, and not subject to formalities.

The acts adopted during the States of Exception that violate protected rights that unreasonably cause suspended rights are subject to actions of amparo. 1. Extraordinary measures may be imposed due to a state of war, state of emergency, or state of natural disaster and last for as long as these states continue.
2. The principles of the activity of public bodies, as well as the extent of limitations on human rights and freedoms during the period of the existence of situations that require extraordinary measures, are defined by law.
3. The law must define the principles, areas and manner of compensation for losses caused as a result of the limitation of human rights and freedoms during the period in which extraordinary measures are imposed.
4. Acts taken as a result of extraordinary measures shall be in proportion with the level of risk and shall aim to re-establish the conditions for the normal functioning of the state, as soon as possible.
5. During the situations that require the imposition of extraordinary measures, none of these acts may be amended: the Constitution, the laws on the election of the Assembly and organs of local government, as well as the laws on extraordinary measures.
6. During the period of implementation of extraordinary measures, there may not be held elections for local government bodies, there may not be a referendum, and a new President of the Republic may not be elected. The elections for the local government bodies may be held only in those places where the extraordinary measures are not implemented. (Art. 170) - Albanian

6. Gjatë periudhës së zbatimit të masave të jashtëzakonshme nuk mund të zhvillohen zgjedhje vendore, nuk mund të zhvillohet referendum, si dhe nuk mund të zgjidhet një President i ri i Republikës. Zgjedhjet vendore mund të bëhen vetëm aty ku nuk zbatohen masat e jashtëzakonshme. (Neni 170)

(c) Any infringement of rights and freedoms under this Constitution and the law shall be only to the extent strictly required by the emergency.

- EnglishThe tribunals of justice cannot qualify the bases [fundamentos] or the factual circumstances invoked by the authority to decree the states of exception, without prejudice to that provided in Article 39. However, concerning the specific measures which affect constitutional rights, the guarantee of recourse before the judicial authorities by means of the recourses that correspond[,] will always exist.
The requisitions that [have been] made give rise to indemnifications, in conformity with the law. The limitations imposed on the right to ownership[,] when they produce deprivation of any of its essential attributes or faculties and so cause injury, will also give rise to the right of indemnification. Limitations and/or Derogations
- EnglishI. The Executive shall report to the Pluri-National Legislative Assembly concerning the reasons for the declaration of the state of emergency, as well as the use that has been made of the powers conferred by the Constitution and the law.
II. Those persons who violate the rights established in this Constitution shall be subject to criminal process for violation of rights.
III. The states of emergency shall be regulated by law. (Art. 139) - SpanishI.
