- EnglishThe President of the Republic, at a meeting of the Cabinet of Ministers, shall have the power to decree states of exception. Expressly defined as such are circumstances of a social, economic, political, natural or ecological nature which seriously affect the security of the Nation, institutions and citizens, in the face of which the powers available to cope with such events are insufficient. In such case, the guarantees contained in this Constitution may be temporarily restricted, with the exception of those relating to the right to life, prohibition of incommunicative detention or torture, the right to due process, the right to information and other intangible human rights. - EnglishI. The rights recognized in this Constitution are inviolable, universal, interdependent, indivisible and progressive. The State has the duty to promote, protect and respect them.
II. The rights declared in this Constitution shall not be understood to deny other rights that are not enumerated.
III. The classification of the rights established in this Constitution does not determine any hierarchy or superiority of some rights over others.
IV. International treaties and conventions ratified by the Pluri-National Legislative Assembly (Asamblea Legislativa), which recognize human rights and prohibit their limitation in States of Emergency, prevail over internal law. The rights and duties consecrated in this Constitution shall be interpreted in accordance with the International Human Rights Treaties ratified by Bolivia. (Art. 13) - SpanishI. - EnglishDuring a state of emergency, the President may, by law or orders, take any measures that shall not derogate from the provisions of this Constitution except as provided herein:
a. to suspend part of the Bill of Rights. However, there shall be no infringement on the right to life, prohibition against slavery, prohibition against torture, the right of non-discrimination on the basis of race, sex, religious creed, the right to litigation or the right to fair trial;
b. to dissolve or suspend any institution of the National Executive;
c. to dissolve or suspend any of the state organs or suspend such powers conferred upon the states under this Constitution; and
d. to take any such measures as deemed necessary to the state of emergency, which shall have the force of law. (Art. 190)

The President of the Republic, with the agreement of the Council of Ministers, may decree, for a determined time period, in all of the national territory or in part of it, and giving account to the Congress or to the Permanent Commission, the states of exception that are contemplated in this Article:
1. [The] state of emergency, in case of disturbance of the peace or of the internal order, of catastrophe or of grave circumstances that affect the life of the Nation. In this eventuality, the exercise of the constitutional rights relative to the freedom and security of persons, the inviolability of the domicile, and the freedom of assembly and of movement in the territory comprehended in paragraphs 9, 11 and 12 of Article 2 and in paragraphs 24, part f in the same Article, may be restricted or suspended. In no circumstances may anyone be banished.
The time period of the state of emergency may not exceed sixty days. Its extension requires [a] new decree. In [a] state of emergency, the Armed Forces assume the control of the domestic order if the President of the Republic so disposes.
2. [The] state of siege, in case of invasion, foreign war or civil war, or imminent danger that such is produced, with mention of those fundamental rights of which the exercise is not restricted or suspended. The corresponding time period may not exceed forty-five days. The state of siege declared, the Congress meets of full right. The extension requires the approval of the Congress. (Art. 137) - Spanish
El Presidente de la República, con acuerdo del Consejo de Ministros, puede decretar, por plazo determinado, en todo el territorio nacional, o en parte de él, y dando cuenta al Congreso o a la Comisión Permanente, los estados de excepción que en este artículo se contemplan:
1. Estado de emergencia, en caso de perturbación de la paz o del orden interno, de catástrofe o de graves circunstancias que afecten la vida de la Nación. En esta eventualidad, puede restringirse o suspenderse el ejercicio de los derechos constitucionales relativos a la libertad y la seguridad personales, la inviolabilidad del domicilio, y la libertad de reunión y de tránsito en el territorio comprendidos en los incisos 9, 11 y 12 del artículo 2° y en el inciso 24, apartado f del mismo artículo. En ninguna circunstancia se puede desterrar a nadie.
El plazo del estado de emergencia no excede de sesenta días. Su prórroga requiere nuevo decreto. En estado de emergencia las Fuerzas Armadas asumen el control del orden interno si así lo dispone el Presidente de la República.
2. Estado de sitio, en caso de invasión, guerra exterior, guerra civil, o peligro inminente de que se produzcan, con mención de los derechos fundamentales cuyo ejercicio no se restringe o suspende. El plazo correspondiente no excede de cuarenta y cinco días. Al decretarse el estado de sitio, el Congreso se reúne de pleno derecho. La prórroga requiere aprobación del Congreso. (Art. 137)

(4) Any legislation enacted in consequence of a declaration of a state of emergency may derogate from the Bill of Rights only to the extent that—
(a) the derogation is strictly required by the emergency; and
(b) the legislation—
(i) is consistent with the Republic’s obligations under international law applicable to states of emergency;
(ii) conforms to subsection (5); and
(iii) is published in the national Government Gazette as soon as reasonably possible after being enacted.
(5) No Act of Parliament that authorises a declaration of a state of emergency, and no legislation enacted or other action taken in consequence of a declaration, may permit or authorise—
(a) indemnifying the state, or any person, in respect of any unlawful act;
(b) any derogation from this section; or
(c) any derogation from a section mentioned in column 1 of the Table of Non-Derogable Rights,5 to the extent indicated opposite that section in column 3 of the Table.6

- EnglishIn the cases of invasion, grave disturbance of the public peace, or any other which places society in grave danger or conflict, only the President of the United Mexican States, with the approval of the Congress of the Union or of the Permanent Commission when it is not meeting, may restrict or suspend in all the country or in a specific place the exercise of the rights and guarantees which could be an obstacle to [a] rapid and effective [fácilmente] response [frente] to the situation; but he must do so for a limited time, by means of general preventions without the restriction or the suspension being limited to a specified person. If the restriction or suspension should take place while the Congress is meeting, it will concede the authorizations that it deems necessary for the Executive to respond to the situation; but if it is verified in a time of recess, the Congress will be convoked immediately to agree to them.
In the decrees which are enacted, [the following] may not be restricted or suspended[:] the exercise of the rights to non-discrimination, to recognition of juridical personality, to life, to personal integrity, to the protection of the family, to [one's] name, to nationality; the rights of the child; the political rights; the freedoms of thought, conscience and of professing any religious belief; the principle of legality and retroactivity; the prohibition of the penalty of death; the prohibition of slavery and servitude; the prohibition of forced disappearance and torture; neither the judicial guarantees indispensible for the protection of these rights.
The restriction or suspension of the exercise of the rights and guarantees must be substantiated and motivated in the terms established by this Constitution and be proportional to the danger that it confronts, observing at each moment the principles of legality, rationality, proclamation, publicity, and non-discrimination.
When the restriction or suspension of the exercise of the rights and guarantees is brought to an end, as well as for the compliance with the time [plazo] or reason [porque] as the Congress decrees [it], all the legal and administrative measures adopted during its effectiveness will be of no effect in immediate form. The Executive may not make observations to the decrees by means of which the Congress revokes the restriction or suspension.
The decrees enacted by the Executive during the restriction or suspension, must be reviewed [revisdos], of office and immediately[,] by the Supreme Court of Justice of the Nation, which must decide on them with the greatest promptness concerning their constitutionality and validity. (Art. 29) - SpanishEn los casos de invasión, perturbación grave de la paz pública, o de cualquier otro que ponga a la sociedad en grave peligro o conflicto, solamente el Presidente de los Estados Unidos Mexicanos, con la aprobación del Congreso de la Unión o de la Comisión Permanente cuando aquel no estuviere reunido, podrá restringir o suspender en todo el país o en lugar determinado el ejercicio de los derechos y las garantías que fuesen obstáculo para hacer frente, rápida y fácilmente a la situación; pero deberá hacerlo por un tiempo limitado, por medio de prevenciones generales y sin que la restricción o suspensión se contraiga a determinada persona. En los decretos que se expidan, no podrá restringirse ni suspenderse el ejercicio de los derechos a la no discriminación, al reconocimiento de la personalidad jurídica, a la vida, a la integridad personal, a la protección a la familia, al nombre, a la nacionalidad; los derechos de la niñez; los derechos políticos; las libertades de pensamiento, conciencia y de profesar creencia religiosa alguna; el principio de legalidad y retroactividad; la prohibición de la pena de muerte; la prohibición de la esclavitud y la servidumbre; la prohibición de la desaparición forzada y la tortura; ni las garantías judiciales indispensables para la protección de tales derechos.
La restricción o suspensión del ejercicio de los derechos y garantías debe estar fundada y motivada en los términos establecidos por esta Constitución y ser proporcional al peligro a que se hace frente, observando en todo momento los principios de legalidad, racionalidad, proclamación, publicidad y no discriminación.
Cuando se ponga fin a la restricción o suspensión del ejercicio de los derechos y garantías, bien sea por cumplirse el plazo o porque así lo decrete el Congreso, todas las medidas legales y administrativas adoptadas durante su vigencia quedarán sin efecto de forma inmediata. El Ejecutivo no podrá hacer observaciones al decreto mediante el cual el Congreso revoque la restricción o suspensión.
Los decretos expedidos por el Ejecutivo durante la restricción o suspensión, serán revisados de oficio e inmediatamente por la Suprema Corte de Justicia de la Nación, la que deberá pronunciarse con la mayor prontitud sobre su constitucionalidad y validez. (Art. 29)

- English1. The President of the Republic, when the circumstances demand it, can declare by way of decree the state of alarm, the state of exception or that of siege, informing the Chamber of the Deputies and the Senate.
2. The proclamation of the state of alarm, of exception or of siege must expressly determine the effects of it and, the territorial scope to which its duration is extended.
3. The law regulates the states of alarm, of exception and of siege, as well as the corresponding competences and limitations.
4. While any of the states comprehended in this Article have been declared[,] the dissolution of the Chambers of Parliament may not proceed.
5. For the creation [actuaci6n] of armed bands or of terrorist elements, with the necessary judicial intervention and the adequate parliamentary control, the rights and guarantees recognized in this Fundamental Law can be suspended in individual or collective form for specific persons[,] in accordance with the Law.
