Obligations of the State

In the national territory each person enjoys state protection and the recognition of the rights inherent to the human person, of the unrestricted respect, promotion and protection of human rights, and the full effectiveness [vigencia] of the rights consigned in the Universal Declaration of Human Rights; in the American Declaration of the Rights and Duties of Man; in the International Pact of Economic, Social and Cultural Rights and in the International Pact of Civil and Political Rights of the Organization of the United Nations[,] and in the American Convention of Human Rights of the Organization of American States. Obligations of the State
- EnglishI. The rights recognized in this Constitution are inviolable, universal, interdependent, indivisible and progressive. The State has the duty to promote, protect and respect them.
II. The rights declared in this Constitution shall not be understood to deny other rights that are not enumerated.
III. The classification of the rights established in this Constitution does not determine any hierarchy or superiority of some rights over others.
IV. International treaties and conventions ratified by the Pluri-National Legislative Assembly (Asamblea Legislativa), which recognize human rights and prohibit their limitation in States of Emergency, prevail over internal law. The rights and duties consecrated in this Constitution shall be interpreted in accordance with the International Human Rights Treaties ratified by Bolivia. (Art. 13) - SpanishI. Los derechos reconocidos por esta Constitución son inviolables, universales, interdependientes, indivisibles y progresivos. El Estado tiene el deber de promoverlos, protegerlos y respetarlos.
II. Los derechos que proclama esta Constitución no serán entendidos como negación de otros derechos no enunciados.
III. La clasificación de los derechos establecida en esta Constitución no determina jerarquía alguna ni superioridad de unos derechos sobre otros.
IV. Los tratados y convenios internacionales ratificados por la Asamblea Legislativa Plurinacional, que reconocen los derechos humanos y que prohíben su limitación en los Estados de Excepción prevalecen en el orden interno. Judicial Protection
- EnglishAll persons have the right to an action of amparo in order to demand before the courts, for themselves or by those who act in their name, immediate protection of their fundamental rights, not protected by habeas corpus, when they are violated or threatened by the action or omission of any public authority or of individuals, in order put into effect the fulfillment of a law or administrative act and in order to guarantee collective and diffuse rights and interests. In accordance with the law, the proceeding is preferential, summary, oral, public, free, and not subject to formalities.
Paragraph
The acts adopted during the States of Exception that violate protected rights that unreasonably cause suspended rights are subject to actions of amparo. (Art. 72) - SpanishToda persona tiene derecho a una acción de amparo para reclamar ante los tribunales, por sí o por quien actúe en su nombre, la protección inmediata de sus derechos fundamentales, no protegidos por el hábeas corpus, cuando resulten vulnerados o amenazados por la acción o la omisión de toda autoridad pública o de particulares, para hacer efectivo el cumplimiento de una ley o acto administrativo, para garantizar los derechos e intereses colectivos y difusos. De conformidad con la ley, el procedimiento es preferente, sumario, oral, público, gratuito y no sujeto a formalidades.
Párrafo.- Los actos adoptados durante los Estados de Excepción que vulneren derechos protegidos que afecten irrazonablemente derechos suspendidos están sujetos a la acción de amparo. (Art. 72)
Political Parties
- EnglishThe political parties and movements, in their functioning, may not:

II. Apply their own normative systems in the regulation and solution of their internal conflicts, subject to the general principles of this Constitution, respecting individual guarantees, human rights and, in relevant manner, the dignity and integrity of women. The law will establish the cases and procedures of validation by the corresponding judges or courts.
III. Elect according to their traditional norms, procedures and practices, the authorities or representatives for the exercise of their own forms of internal government, guaranteeing that indigenous women and men will enjoy and will exercise their right to vote and to be voted for in conditions of equality; as well as to accede to and to hold the public offices [cargos] and [offices] of public election for those that have been elected or designated, in a framework [that] respects the federal pact, the sovereignty of the States and the autonomy of the City of Mexico. VIII. Acceder plenamente a la jurisdicción del Estado. Para garantizar ese derecho, en todos los juicios y procedimientos en que sean parte, individual o colectivamente, se deberán tomar en cuenta sus costumbres y especificidades culturales respetando los preceptos de esta Constitución. Los indígenas tienen en todo tiempo el derecho a ser asistidos por intérpretes y defensores que tengan conocimiento de su lengua y cultura.
