- English(1) Subject to the provisions of section 22(2), 38(8)(b), 102(2) and 105(10) of this Constitution, any person who alleges that any provisions of this Constitution (other than a provision of Chapter 13 thereof) has been or is being contravened may, if he has a relevant interest, apply to the High Court for a declaration and for relief under this section.
(2) The High Court shall have jurisdiction on an application made under this section to determine whether any provision of this Constitution (other than a provision of Chapter 1 thereof) has been or is being contravened and to make a declaration accordingly.
(3) Where the High Court makes a declaration under this section that a provision of this Constitution has been or is being contravened and the person on whose application the declaration is made has also applied for relief, the High Court may grant to that person such remedy as it considers appropriate, being a remedy available generally under any law in proceedings in the High Court.
(4) The Chief Justice may make rules with respect to the practice and procedure of the High Court in relation to the jurisdiction and powers conferred on the Court by or under this section, including provisions with respect to the time within which any application under this section may be made.
(5) A person shall be regarded as having a relevant interest for the purpose of an application under this section only if the contravention of this Constitution alleged by him is such as to affect his interests.
(6) The rights conferred on a person by this section to apply for a declaration and relief in respect of an alleged contravention of this Constitution shall be in addition to any other action in respect of the same matter that may be available to that person under any law.
(7) Nothing in this section shall confer jurisdiction on the High Court to hear or determine any such question as is referred to in section 36 of this Constitution. (Sec. 96)

- English(1) The Constitutional Court has jurisdiction over the whole Spanish territory and is entitled to hear:
a) Appeals against the alleged unconstitutionality of acts and statutes having the force of an act. ...
b) Individual appeals for protection (recursos de amparo) against violation of the rights and liberties contained in section 53(2) of the Constitution, in the circumstances and manner to be laid down by law.
c) Conflicts of jurisdiction between the State and the Autonomous Communities or between the Autonomous Communities themselves.
d) Other matters assigned to it by the Constitution or by organic acts.
(2) The Government may appeal to the Constitutional Court against provisions and resolutions adopted by the bodies of the Autonomous Communities, which shall bring about the suspension of the contested provisions or resolutions, but the Court must either ratify or lift the suspension, as the case may be, within a period of not more than five months. - English1. At the request of the President of the Republic or, on the grounds of infringement of the laws of the Autonomous Region of Príncipe, of the Chairman of the Regional Legislative, the Constitutional Court shall review and verify non-compliance with the Constitution by omission of the legislative measures necessary for making the constitutional rules enforceable.
2. Whenever the Constitutional Court verifies the existence of unconstitutionality by omission, it shall notify the appropriate legislative body. (Art. 148) - Portuguese1. - English(1) The Supreme Court shall have sole and exclusive jurisdiction to hear and determine any question relating to the interpretation of the Constitution and accordingly, whenever any such question arises in the course of any proceedings in any other court or tribunal or other institution empowered by law to administer justice or to exercise judicial or quasi-judicial functions, such question shall forthwith be referred to the Supreme Court for determination. The Supreme Court may direct that further proceedings be stayed pending the determination of such question.

(a) the Attorney-General acting in the name of the people of the Republic of the Marshall Islands, and all persons directly affected by an alleged violation of this Constitution, whether by private individuals or public officials, shall have standing to complain of such violation in a case or controversy that is the subject of an appropriate judicial proceeding;

- English1. The Supreme Court shall be the custodian of this Constitution and the constitutions of the states.
2. The Supreme Court shall exercise competences as follows:
a. interpret constitutional provisions at the instance of the President, Government of South Sudan, any state government, or any of the two Houses of the National Legislature;
b. be the court of final judicial instance in respect of any litigation or prosecution under National or state law, including statutory and customary law;
c. have original jurisdiction to decide on disputes that arise under this Constitution and the constitutions of states at the instance of individuals, juridical entities or governments;
d. adjudicate on the constitutionality of laws and set aside or strike down laws or provisions of laws that are inconsistent with this Constitution or the constitutions of the states to the extent of the inconsistency;
e. be a court of review and cassation in respect of any criminal, civil and administrative matters arising out of or under the law;
f. have criminal jurisdiction over the President in accordance with Article 103 (2) herein;
g. have criminal jurisdiction over the Vice President, the Speakers of the National Legislative Assembly and the Council of States and the Justices of the Supreme Court;
h. review death sentences imposed by courts in respect of offences committed under the law;
i. receive appeals against decisions and judgments of the courts of appeal;
j. have original and final jurisdiction to resolve disputes between the states and between the National Government and a state in respect of areas of exclusive, concurrent or residual competences;
k. uphold and protect human rights and fundamental freedoms; and
l. have such other competences as prescribed by this Constitution and the law.
