Composition and Appointment

(1) A person is qualified for appointment as a judge of the Constitutional Court if he or she is a Zimbabwean citizen, is at least forty years old and has a sound knowledge of constitutional law and, in addition, possesses one of the following qualifications—
(a) he or she has been a judge of a court with unlimited jurisdiction in civil or criminal matters in a country in which the common law is Roman-Dutch or English, and English is an officially recognised language; or
(b) for at least twelve years, whether continuously or not, he or she has been qualified to practise as a legal practitioner—
(i) in Zimbabwe; or
(ii) in a country in which the common law is Roman-Dutch or English and English is an officially recognised language;
and is currently so qualified to practise.

(2) To be appointed as a judge of the Constitutional Court a person must be a fit and proper person to hold office as a judge. (Sec. 177)

- English(1) The Supreme Court shall, save as otherwise provided in section 122 of this Constitution, have original jurisdiction, to the exclusion of all other Courts—
a. in all matters relating to the enforcement or interpretation of any provision of this Constitution; and
b. where any question arises whether an enactment was made in excess of the power conferred upon Parliament or any other authority or person by law or under this Constitution.
(2) Where any question relating to any matter or question as is referred to in subsection (1) arises in any proceedings in any Court, other than the Supreme Court, that Court shall stay the proceedings and refer the question of law involved to the Supreme Court for determination; and the Court in which the question arose shall dispose of the case in accordance with the decision of the Supreme Court. - English(1) The Appellate Division shall have jurisdiction to hear and determine appeals from judgments, decrees, orders or sentences of the High Court Division.
(2) An appeal to the Appellate Division from a judgment, decree, order or sentence of the High Court Division shall lie as of right where the High Court Division –
(a) certifies that the case involves a substantial question of law as to the interpretation of this Constitution;

- English(1) The Constitutional Court is an independent court, separate from the judicial authority. It is competent to oversee the constitutionality of laws and measures, protect rights and freedoms, and adjudicate constitutional disputes.

The Supreme Constitutional Court shall have exclusive jurisdiction to adjudicate on any appeal made against a decision of an Administrative Court having exclusive jurisdiction to decide in the first instance on a recourse made to it on a complaint that a decision, an act or omission of any organ, authority or person, exercising any executive or administrative authority is contrary to any of the provisions of this Constitution or of any law or is made in excess or in abuse of powers vested in such organ or authority or person.

2. Such a recourse may be made by a person whose any existing legitimate interest, which he has either as a person or by virtue of being a member of a Community, is adversely and directly affected by such decision or act or omission.

- EnglishThe Constitutional Court shall consider and adopt decisions on whether the laws of the Republic of Lithuania or other acts adopted by the Seimas are in conflict with the Constitution of the Republic of Lithuania.
The Constitutional Court shall also consider whether the following are in conflict with the Constitution and laws:
1) the acts of the President of the Republic;
2) the acts of the Government of the Republic.
The Constitutional Court shall present conclusions on:
1) whether there were the violations of election laws during the elections of the President of the Republic or the elections of the Members of the Seimas;
2) whether the state of health of the President of the Republic allows him to continue to hold office;
3) whether the international treaties of the Republic of Lithuania are in conflict with the Constitution;
4) whether the concrete actions of the Members of the Seimas and state officials against whom an impeachment case has been instituted are in conflict with the Constitution (Art. 105) - LithuanianKonstitucinis Teismas nagrinėja ir priima sprendimą, ar neprieštarauja Lietuvos Respublikos Konstitucijai Lietuvos Respublikos įstatymai ir kiti Seimo priimti aktai.

Where any question as to the interpretation of this Constitution arises in any court of law established for Antigua and Barbuda (other than the Court of Appeal, the High Court or a court-martial) and the court is of the opinion that the question involves a substantial question of law, the court may, and shall if any party to the proceedings so requests, refer the question to the High Court.
