Jurisdiction and Access
- English1. The Constitutional Court shall review and declare with general mandatory force:
a) The unconstitutionality of any rules;
b) The illegality of any provision of legislative acts on the grounds of infringement of a law of superior force;
c) The illegality of any legal rule of a regional legislative on the grounds of infringement of the Political and Administrative Statute of the Autonomous Region of Príncipe or of the general law of the Republic;
d) The illegality of any set of legal rules of legislatives issued by sovereign bodies on the grounds of infringement of the laws of the Autonomous Region of Príncipe enshrined in its Statute.
2. The Constitutional Court may be requested by the following officials to declare the unconstitutionality or the illegality, with general mandatory force:
a) The President of the Republic;
b) The Chairman of the National Assembly;
c) The Prime Minister;
d) The Attorney General of the Republic;
e) One tenth of the Deputies of the National Assembly;
f) The Regional Legislative Assembly and the President of the Regional Government of Príncipe.
3. The Constitutional Court shall review and furthermore declare, in general mandatory force, the unconstitutionality or illegality of any rule, so long as it has judged by it as unconstitutional or illegal in three concrete cases. (Art. 147) - Portuguese1. O Tribunal Constitucional aprecia e declara, com força obrigatória geral:
a) A inconstitucionalidade de quaisquer normas;
b) A ilegalidade de quaisquer normas constantes de actos legislativos com fundamento em violação da lei com valor reforçado;
c) A ilegalidade de quaisquer normas constantes de diploma regional com fundamento em violação do Estatuto Político-Administrativo da Região Autónoma do Príncipe ou de lei geral da República;
d) A ilegalidade de quaisquer normas constantes de diplomas emanados dos órgãos de soberania com fundamento em violação dos direitos da Região Autónoma do Príncipe consagrados no seu Estatuto.
2. Podem requerer ao Tribunal Constitucional a declaração da inconstitucionalidade ou de ilegalidade, com força obrigatória geral:
a) O Presidente da República;
b) O Presidente da Assembleia Nacional;
c) O Primeiro-Ministro;
d) O Procurador Geral da República;
e) Um décimo dos Deputados à Assembleia Nacional;
f) A Assembleia Legislativa Regional e o Presidente do Governo Regional do Príncipe.
3. O Tribunal Constitucional aprecia e declara ainda, com força obrigatória geral, a inconstitucionalidade ou a ilegalidade de qualquer norma, desde que tenha sido por ele julgada inconstitucional ou ilegal em três casos concretos. (Art. 147)

- English(1) The remedy of judicial review is and shall not be available in Brunei Darussalam.
(2) For the avoidance of doubt, there is and shall be no judicial review in any court of any act, decision, grant, revocation or suspension, or refusal or omission to do so, any exercise of or refusal or omission to exercise any power, authority or discretion by His Majesty the Sultan and Yang Di-Pertuan, or any party acting on his behalf or under his authority or in the performance of any public function, under the provisions of this Constitution or any written law or otherwise, including any question relating to compliance with any procedural requirement governing such act or decision.
(3) In this Article, “judicial review” means proceedings instituted by any manner whatsoever including, but not limited to, proceedings by way of —

(d) any other suit or action relating to or arising out of any act, decision, grant, revocation or suspension, or refusal or omission to do so, any exercise of or refusal or omission to exercise any power, authority or discretion conferred on His Majesty the Sultan and Yang Di-Pertuan, or any party acting on his behalf or under his authority or in the performance of any public function, under the provisions of this Constitution or any written law or otherwise.
(4) Save as provided in this Constitution, His Majesty the Sultan and Yang Di-Pertuan shall not be required to assign any reason for any act, decision, grant, revocation or suspension, or refusal or omission to do so, any exercise of or refusal or omission to exercise any power, authority or discretion under the provisions of this Constitution or any written law or otherwise. - EnglishThe President of the Republic, the two political party groups having the largest number of members in the Grand National Assembly of Turkey, and at least one-fifth of the total number of members of the Grand National Assembly of Turkey shall have the right to apply for annulment action directly to the Constitutional Court, based on the assertion of the unconstitutionality, in form and in substance, of laws, of presidential decrees, of Rules of Procedure of the Grand National Assembly of Turkey or of certain articles or provisions thereof. (1) Subject to subsection (2), the High Court has original jurisdiction to determine any question as to the interpretation or application of this Constitution.
(2) Where —
(a) any question as to the interpretation or application of this Constitution arises in any proceedings in a subordinate court; and
(b) that court is of the opinion that the question involves a substantial question of law,
the court may, and shall if a party to the proceedings so requests, refer the question to the High Court for determination. (Sec. 134)

- English1. Appeals of unconstitutionality against laws or statutory rules may be lodged by one fifth of the General Council, the Head of Government and three Local Councils. One fifth of the General Council may lodge an appeal of unconstitutionality against the Rules of Procedure of the Chamber. The appeal shall be lodged within the thirty days following the publication of the rule.
