- EnglishThe workers of both sexes have the same labor rights and obligations, but maternity will be subject to special protection, that will include the assistance services and the corresponding leaves of absence [descansos], which will not be less than 12 weeks. A woman may not be terminated [despedida] during the pregnancy, or as long as the leaves of absence for maternity continue.

Under no circumstances may they be discriminated on account of their sex.
(2) The law shall regulate a Workers' Statute. (Sec. 35) - Spanish1. - EnglishEveryone shall have the right to work, to choose the profession, job, work protection and social protection during the unemployment. Wages for work shall not be less than the minimum wage.
Any limitation shall be prohibited in labor relations. Equal wages shall be paid for the same work.
Forced labor shall not be permitted, except in cases defined by law.
Using women and children labor shall be prohibited in heavy and underground works and in harmful conditions. - English(1) It is unlawful for a person (in the course of that person’s involvement in any of the areas to which this subsection is applied by subsection (2)) to treat adversely any other person, or to make an implied or overt threat to treat adversely any other person, on the ground that the other person is, or is suspected or assumed or believed to be, a person affected by domestic violence.
(2) The areas to which subsection (1) applies are—
(a) the making of an application for employment:
(b) employment, which term includes unpaid work.
(3) In this section, an employer treats adversely an employee if the employer—
(a) dismisses that employee, in circumstances in which other employees employed by that employer on work of that description are not or would not be dismissed or subjected to such detriment; or
(b) refuses or omits to offer or afford to that employee the same terms of employment, conditions of work, fringe benefits, or opportunities for training, promotion, and transfer as are made available for other employees of the same or substantially the same qualifications, experience, or skills employed in the same or substantially similar circumstances; or
(c) subjects that employee to any detriment, in circumstances in which other employees employed by that employer on work of that description are not or would not be subjected to such detriment; or
(d) retires that employee, or requires or causes that employee to retire or resign.
(4) For the purposes of this section,— child has the meaning given to it in section 8 of the Family Violence Act 2018
family violence has the meaning given to it in section 9 the Family Violence Act 2018, person affected by family violence means a person who is 1 or both of the following:
(a) a person against whom any other person is inflicting, or has inflicted, family violence:
(b) a person with whom there ordinarily or periodically resides a child against whom any other person is inflicting, or has inflicted, family violence.
(5) Subsection (1) applies regardless of how long ago the family violence occurred or is suspected or assumed or believed to have occurred, and even if the family violence occurred or is suspected or assumed or believed to have occurred before the person became an employee. - EnglishAll persons have the right and duty to work. The State guarantees the adoption of the necessary measures so that every person shall be able to obtain productive work providing him or her with a dignified and decorous living and guarantee him or her the full exercise of this right. It is an objective of the State to promote employment. Measures tending to guarantee the exercise of the labor rights of self employed persons shall be adopted by law. Freedom to work shall be subject only to such restrictions as may be established by law.
Every employer shall guarantee employees adequate safety, hygienic and environmental conditions on the job. The State shall adopt measures and create institutions such as to make it possible to control and promote these conditions. (Art. 87) - SpanishToda persona tiene derecho al trabajo y el deber de trabajar. El Estado garantizará la adopción de las medidas necesarias a los fines de que toda persona pueda obtener ocupación productiva, que le proporcione una existencia digna y decorosa y le garantice el pleno ejercicio de este derecho. Es fin del Estado fomentar el empleo. La ley adoptará medidas tendentes a garantizar el ejercicio de los derechos laborales de los trabajadores y trabajadoras no dependientes. Todo patrono o patrona garantizará a sus trabajadores y trabajadoras condiciones de seguridad, higiene y ambiente de trabajo adecuados. El Estado adoptará medidas y creará instituciones que permitan el control y la promoción de estas condiciones. (Art. 87)
