- English1. The Supreme Court of Justice has jurisdiction to hear appeals against any of the following court decisions:
a) Decisions refusing to apply a legal rule on the grounds of unconstitutionality;
b) Decisions applying a legal rule the constitutionality of which was challenged during the proceedings.
2. An appeal under paragraph (1) (b) may be brought only by the party who raised the question of unconstitutionality.

2. O recurso previsto na alínea b) do número anterior só pode ser interposto pela parte que tenha suscitado a questão da inconstitucionalidade.

The High Court has the jurisdiction in relation to the interpretation, application and enforcement of this Constitution conferred by —
(a) section 14 (Parliamentary declaration of purpose);
(b) Part II, Division 5 (Enforcement of the Bill of Rights); and
(c) section 134 (constitutional interpretation), and otherwise by law. (Sec. 5)

A Head of an Institution or one-quarter of the members composing one of the Parliamentary Assemblies or the organs of the Decentralized Territorial Collectivities or the High Council for the Defense of Democracy and of the State of Law may refer to the Constitutional Court, for control of constitutionality, any text with legislative or regulatory value as well as all matters falling into its competence.
If, before a jurisdiction, a party raises an exception of unconstitutionality, that jurisdiction postpones its decision and refers the matter to the High Constitutional Court which decides within the time period of one month.
In the same way, if before a jurisdiction, a party maintains that a provision of a legislative or regulatory text infringes their fundamental rights recognized by the Constitution, that jurisdiction postpones its decision within the same conditions as in the previous paragraph.

Un Chef d’Institution ou le quart des membres composant l’une des Assemblées parlementaires ou les organes des Collectivités Territoriales Décentralisées ou le Haut Conseil pour la Défense de la Démocratie et de l’Etat de droit peuvent déférer à la Cour Constitutionnelle, pour contrôle de constitutionnalité, tout texte à valeur législative ou réglementaire ainsi que toutes matières relevant de sa compétence.
Si devant une juridiction, une partie soulève une exception d’inconstitutionnalité, cette juridiction sursoit à statuer et saisit la Haute Cour Constitutionnelle qui statue dans le délai d’un mois.

The Constitutional Court is competent to take cognizance of a pleading [exception] of unconstitutionality raised in the course of a process, when it is maintained by one of the parties that the law on which the issue of the litigation depends, infringes the rights and freedoms guaranteed by the Constitution.

Such constitutional act shall be adopted in accordance with the procedure determined for amending the Constitution.

The Constitutional Council is referred to [a matter] by:
• the President of Faso;
• the Prime Minister;
• the President of the National Assembly;
• one-tenth (1/10) at least of the members of the National Assembly.
In addition, any citizen may refer [a matter] to the Constitutional Council concerning the constitutionality of the laws, either directly, or through the procedure of the pleadings [exception] of unconstitutionality invoked in a matter [affaire] which concerns them before a jurisdiction. This must postpone [the matter] until the decision of the Constitutional Council which must intervene within a maximum period of time of thirty days counting from its referral [to the matter].
The Constitutional Council can refer itself to any questions relative to its competence, if it judges it necessary. (Art. 157) - French
Le Conseil constitutionnel est saisi par :
• le Président du Faso;
• le Premier ministre;
• le Président de l'Assemblée nationale;
• un dixième (1/10) au moins des membres de chaque chambre du Parlement.
En outre, tout citoyen peut saisir le Conseil constitutionnel sur la constitutionnalité des lois, soit directement, soit par la procédure de l’exception d’inconstitutionnalité invoquée dans une affaire qui le concerne devant une juridiction. Celle-ci doit surseoir jusqu’à la décision du Conseil constitutionnel qui doit intervenir dans un délai maximum de trente jours à compter de sa saisine.
Le Conseil constitutionnel peut se saisir de toutes questions relevant de sa compétence s’il le juge nécessaire. (Art. 157)

- English(1) The Supreme Court shall have jurisdiction, to the exclusion of any other court of law in Nigeria, to hear and determine appeals from the Court of Appeal.
(2) An appeal shall lie from the decisions of the Court of Appeal to the Supreme Court as of right in the following cases–

(b) decisions in any civil or criminal proceedings on questions as to the interpretation or application of this Constitution;
(c) decisions in any civil or criminal proceedings on questions as to whether any of the provisions of Chapter IV4 of this Constitution has been, is being or is likely to be, contravened in relation to any person;
