2. Subject to sections 18 and 49, and to subsections (9) and (12) of this section, and save only as may be demonstrably justified in a free and democratic society-

The State is founded on the principles of democratic representation, of separation of the powers, of the guarantee of the rights and freedoms and of social justice.
The elected assembly constitutes the framework by which the will of the people is expressed and the control of the action of the public powers is exercised.
