- EnglishIn no case, even when the state of siege or the state of urgency has been proclaimed in accordance with Articles 85 and 86 of this Constitution, can there be derogation of the rights and fundamental principles enumerated as follows:
1. the right to life;
2. the prohibition of torture and of cruel, inhuman or degrading punishments or treatment;
3. the prohibition of slavery and of servitude;
4. the principle of the legality of infractions and of penalties;
5. the right to [a] defense and the right to recourse;
6. the prohibition of imprisonment for debts;
7. the freedom of thought, of conscience and of religion. - EnglishI. The rights recognized in this Constitution are inviolable, universal, interdependent, indivisible and progressive. The State has the duty to promote, protect and respect them.
II. The rights declared in this Constitution shall not be understood to deny other rights that are not enumerated.
III. The classification of the rights established in this Constitution does not determine any hierarchy or superiority of some rights over others.
IV. International treaties and conventions ratified by the Pluri-National Legislative Assembly (Asamblea Legislativa), which recognize human rights and prohibit their limitation in States of Emergency, prevail over internal law. The rights and duties consecrated in this Constitution shall be interpreted in accordance with the International Human Rights Treaties ratified by Bolivia. (Art. 13) - SpanishI. - EnglishIn the case of imminent danger, when the declaration of the State of exception or of siege is declared [se acuerde], the President of the Republic can suspend[,] for a maximum time of three months[,] the rights and guarantees established in this Fundamental Law and take exceptional measures to safeguard the territorial integrity, the national independence, the institutions of the State and the functioning of public powers and services[,] informing the People by message. The time of three months referred to may be extended until the causes that motivated this suspension have disappeared. (Art. 43)
