Ecuador
- EnglishWhen a judge, by virtue of his/her office or at the request of a party, considers that a legal norm is contrary to the Constitution or to international human rights instruments that provide for rights that are more favorable than those enshrined in the Constitution, it shall suspend the case and refer it for consultation to the Constitutional Court, which within no more than forty-five (45) days shall rule on the constitutionality of the norm.
If the Court issues no ruling within the established time-limits, the affected party is entitled to file the corresponding complaint. (Art. 428) - SpanishCuando una jueza o juez, de oficio o a petición de parte, considere que una norma jurídica es contraria a la Constitución o a los instrumentos internacionales de derechos humanos que establezcan derechos más favorables que los reconocidos en la Constitución, suspenderá la tramitación de la causa y remitirá en consulta el expediente a la Corte Constitucional, que en un plazo no mayor a cuarenta y cinco días, resolverá sobre la constitucionalidad de la norma.

على أن معاهدات الصلح والتحالف، والمعاهدات المتعلقة بأراضي الدولة أو ثرواتها الطبيعية أو بحقوق السيادة أو حقوق المواطنين العامة أو الخاصة، ومعاهدات التجارة والملاحة، والإقامة، والمعاهدات التي تحمل خزانة الدولة شيئاً من النفقات غير الواردة في الميزانية أو تتضمن تعديلاً لقوانين الكويت يجب لنفاذها أن تصدر بقانون. ولا يجوز في أي حال أن تتضمن المعاهدة شروطاً سرية تناقض شروطها العلنية.

In the affirmative, the Constitution is modified before the ratification of those [desdits] engagements.

- English1. After promulgation thereof in the Journal of Laws of the Republic of Poland (Dziennik Ustaw), a ratified international agreement shall constitute part of the domestic legal order and shall be applied directly, unless its application depends on the enactment of a statute.
2. An international agreement ratified upon prior consent granted by statute shall have precedence over statute if such an agreement cannot be reconciled with the provisions of such statute.
3. If an agreement, ratified by the Republic of Poland, establishing an international organization so provides, the laws established by it shall be applied directly and have precedence in the event of a conflict of laws. 2. Umowa międzynarodowa ratyfikowana za uprzednią zgodą wyrażoną w ustawie ma pierwszeństwo przed ustawą, jeżeli ustawy tej nie da się pogodzić z umową.
3. Jeżeli wynika to z ratyfikowanej przez Rzeczpospolitą Polską umowy konstytuującej organizację międzynarodową, prawo przez nią stanowione jest stosowane bezpośrednio, mając pierwszeństwo w przypadku kolizji z ustawami. (Art. 91)
