Obligations of the State
- EnglishI. The rights recognized in this Constitution are inviolable, universal, interdependent, indivisible and progressive. The State has the duty to promote, protect and respect them.
II. The rights declared in this Constitution shall not be understood to deny other rights that are not enumerated.
III. The classification of the rights established in this Constitution does not determine any hierarchy or superiority of some rights over others.
IV. International treaties and conventions ratified by the Pluri-National Legislative Assembly (Asamblea Legislativa), which recognize human rights and prohibit their limitation in States of Emergency, prevail over internal law. The rights and duties consecrated in this Constitution shall be interpreted in accordance with the International Human Rights Treaties ratified by Bolivia. (Art. 13) - SpanishI. Los derechos reconocidos por esta Constitución son inviolables, universales, interdependientes, indivisibles y progresivos. El Estado tiene el deber de promoverlos, protegerlos y respetarlos.
II. Los derechos que proclama esta Constitución no serán entendidos como negación de otros derechos no enunciados.
III. La clasificación de los derechos establecida en esta Constitución no determina jerarquía alguna ni superioridad de unos derechos sobre otros.
IV. Los tratados y convenios internacionales ratificados por la Asamblea Legislativa Plurinacional, que reconocen los derechos humanos y que prohíben su limitación en los Estados de Excepción prevalecen en el orden interno. - English(1) Constitutional provisions concerning the citizens' rights and liberties shall be interpreted and enforced in conformity with the Universal Declaration of Human Rights, with the covenants and other treaties Romania is a party to.
(2) Where any inconsistencies exist between the covenants and treaties on the fundamental human rights Romania is a party of, and the national laws, the international regulations shall take precedence, unless the Constitution or national laws comprise more favourable provisions. - EnglishHuman and minority rights guaranteed by the Constitution shall be implemented directly.
The Constitution shall guarantee, and as such, directly implement human and minority rights guaranteed by the generally accepted rules of international law, ratified international treaties and laws. The law may prescribe manner of exercising these rights only if explicitly stipulated in the Constitution or necessary to exercise a specific right owing to its nature, whereby the law may not under any circumstances influence the substance of the relevant guaranteed right.
Provisions on human and minority rights shall be interpreted to the benefit of promoting values of a democratic society, pursuant to valid international standards in human and minority rights, as well as the practice of international institutions which supervise their implementation. Уставом се јемче, и као таква, непосредно се примењују људска и мањинска права зајемчена општеприхваћеним правилима међународног права, потврђеним међународним уговорима и законима. Законом се може прописати начин остваривања ових права само ако је то Уставом изричито предвиђено или ако је то неопходно за остварење појединог права због његове природе, при чему закон ни у ком случају не сме да утиче на суштину зајемченог права.

The State shall commit itself to joining international and regional declarations and charters which protect such rights and freedoms. - EnglishThe interpretation and regulation of the fundamental rights and guarantees, recognized in the present Constitution, shall be ruled by the following principles:
1. They do not have limiting character and consequently, do not exclude other rights and guarantees of an equal nature.
2. Only by law, in the cases permitted by this Constitution, may the exercise of the fundamental rights and guarantees be regulated, respecting their essential content and the principle of reasonableness.
3. Treaties, pacts, and conventions related to human rights, adopted and ratified by the Dominican State have constitutional hierarchy and are for direct and immediate application by the courts and other organs of the State.
4. The public powers interpret and apply the norms related to fundamental rights and their guarantees, in the sense most favorable to the person in possession of the same, in the case of conflict between fundamental rights, they shall attempt to harmonize the assets and interests protected by this Constitution. (Art. 74) - SpanishLa interpretación y reglamentación de los derechos y garantías fundamentales, reconocidos en la presente Constitución, se rigen por los principios siguientes:
1) No tienen carácter limitativo y, por consiguiente, no excluyen otros derechos y garantías de igual naturaleza;
2) Sólo por ley, en los casos permitidos por esta Constitución, podrá regularse el ejercicio de los derechos y garantías fundamentales, respetando su contenido esencial y el principio de razonabilidad;
3) Los tratados, pactos y convenciones relativos a derechos humanos, suscritos y ratificados por el Estado dominicano, tienen jerarquía constitucional y son de aplicación directa e inmediata por los tribunales y demás órganos del Estado;
4) Los poderes públicos interpretan y aplican las normas relativas a los derechos fundamentales y sus garantías, en el sentido más favorable a la persona titular de los mismos y, en caso de conflicto entre derechos fundamentales, procurarán armonizar los bienes e intereses protegidos por esta Constitución.
