- EnglishThe authorities of the indigenous communities, peoples, and nations shall perform jurisdictional duties, on the basis of their ancestral traditions and their own system of law, within their own territories, with a guarantee for the participation of, and decision-making by, women. The authorities shall apply their own standards and procedures for the settlement of internal disputes, as long as they are not contrary to the Constitution and human rights enshrined in international instruments.
The State shall guarantee that the decisions of indigenous jurisdiction are observed by public institutions and authorities. These decisions shall be subject to monitoring of their constitutionality. The law shall establish the mechanisms for coordination and cooperation between indigenous jurisdiction and regular jurisdiction. (Art. 171) - SpanishLas autoridades de las comunidades, pueblos y nacionalidades indígenas ejercerán funciones jurisdiccionales, con base en sus tradiciones ancestrales y su derecho propio, dentro de su ámbito territorial, con garantía de participación y decisión de las mujeres. The Rural and the Native communities have legal existence and are juridical persons.
They are autonomous in their organization, in the communal work and in the use and free disposition of their lands, as well as in economic and administrative [matters], within the framework that the law establishes. The ownership of their lands is imprescriptible, except in the case of abandonment provided for in the preceding Article. The State respects the cultural identity of the Rural and Native Communities. Notwithstanding the preceding provisions, the Constitutional Council may also be composed of one or more members of the indigenous peoples recognized in Law No. 19,253, which establishes norms for the protection, promotion, and development of indigenous peoples and creates the National Corporation for Indigenous Development, in force as of the date of publication of this reform. The following special rules shall apply for these purposes:
1. Indigenous individuals who are citizens with the right to vote may declare their candidacies, and the general disqualifications, incompatibilities, and prohibitions for being a member of the Constitutional Council shall also apply to them. Candidacies must prove their status as members of an indigenous people by means of the corresponding certificate of indigenous status issued by the National Corporation for Indigenous Development.

- English(1) Community land shall vest in and be held by communities identified on the basis of ethnicity, culture or similar community of interest.
(2) Community land consists of—
(a) land lawfully registered in the name of group representatives under the provisions of any law;
(b) land lawfully transferred to a specific community by any process of law;
(c) any other land declared to be community land by an Act of Parliament; and
(d) land that is—
(i) lawfully held, managed or used by specific communities as community forests, grazing areas or shrines;
(ii) ancestral lands and lands traditionally occupied by hunter-gatherer communities; or
(iii) lawfully held as trust land by the county governments, but not including any public land held in trust by the county government under Article 62(2).
