The following recourses and mechanisms of constitutional control are also established:
1) The Recourse of Habeas Data as guarantee of protection [tutela] of personal data established [asentados] in archives, registers, databases or other technical means, of public or private nature, whose publicity constitutes [an] invasion of personal privacy and has relevance to the treatment of sensitive data of the persons in their intimate and familiar domain [ámbito]. The Recourse of Habeas Data proceeds in favor of any person to know in what circumstances, to what ends, when, and who makes contact with their personal data and its improper [indebida] publicity.
2) The conflict of competence and constitutionality between the Powers of the State. The representatives of the Powers of the State will promote the conflict of competence and constitutionality when they consider that a law, decree or regulation, act, resolution or provision of another organ [órgano], invades the domain of their privative constitutional competences.
3) The control of constitutionality in [a] concrete case as incidental mechanism of control. When in a case submitted to the cognizance of [a] judicial authority, it considers that a norm on whose validity the decision [fallo] depends is contrary to the Constitution, it must proceed to declare its unconstitutionality for that specific [en concreto] case. The parties in the process may solicit the unconstitutionality of a norm that is being applied to the case. The judicial authority must pronounce itself on the point, accepting [acogiendo] or rejecting the claim [pretensión].
4) The conflicts of constitutionality between the Central Government and the Municipal Governments and [Governments] of the Autonomous Regions of the Caribbean Coast.

Se establecen también los siguientes recursos y mecanismos de control constitucional:
1) El Recurso de Habeas Data como garantía de tutela de datos personales asentados en archivos, registros, bancos de datos u otros medios técnicos, de naturaleza pública o privada, cuya publicidad constituya invasión a la privacidad personal y tenga relevancia con el tratamiento de datos sensibles de las personas en su ámbito íntimo y familiar. El Recurso de Habeas Data procede a favor de toda persona para saber quién, cuándo, con qué fines y en qué circunstancias toma contacto con sus datos personales y su publicidad indebida.
2) El conflicto de competencia y constitucionalidad entre los Poderes del Estado. Los representantes de los Poderes del Estado promoverán el conflicto de competencia y constitucionalidad cuando consideren que una ley, decreto o reglamento, acto, resolución o disposición de otro órgano, invade el ámbito de sus competencias privativas constitucionales.
3) El control de constitucionalidad en caso concreto como un mecanismo incidental de control. Cuando en un caso sometido al conocimiento de autoridad judicial, ésta considere que una norma de cuya validez depende el fallo es contraria a la Constitución, deberá proceder a declarar su inconstitucionalidad para el caso en concreto. Las partes en el proceso pueden solicitar la inconstitucionalidad de una norma que se esté aplicando al caso. La autoridad judicial deberá pronunciarse sobre el punto, acogiendo o rechazando la pretensión.
4) Los conflictos de constitucionalidad entre el Gobierno Central y los Gobiernos Municipales y de las Regiones Autónomas de la Costa Caribe.

(2) Except for Part IX Land and Titles Court, an appeal shall lie to the Court of Appeal from any decision of the Supreme Court in any proceeding, if the Supreme Court certifies that the case involves a substantial question of law as to the interpretation or effect of any provision of this Constitution; and:

(2) The Supreme Court shall be presided over by the Chief Justice and shall hear and adjudicate upon appeals emanating from the High Court, including appeals which involve the interpretation, implementation and upholding of this Constitution and the fundamental rights and freedoms guaranteed thereunder. b) to annul other legal enactments or individual provisions thereof if they are in conflict with the constitutional order or a statute;
c) over constitutional complaints by the representative body of a self-governing region against an unlawful encroachment by the state;
d) over constitutional complaints against final decisions or other encroachments by public authorities infringing constitutionally guaranteed fundamental rights and basic freedoms;
e) over remedial actions from decisions concerning the certification of the election of a deputy or senator;
f) to resolve doubts concerning a deputy or senator’s loss of eligibility to hold office or the incompatibility under Article 25 of some other position or activity with holding the office of deputy or senator;
g) over a constitutional charge brought by the Senate against the president of the republic pursuant to Article 65, paragraph 2;
h) to decide on a petition by the president of the republic seeking the revocation of a joint resolution of the Chamber of Deputies and the Senate pursuant to Article 66;
i) to decide on the measures necessary to implement a decision of an international tribunal which is binding on the Czech Republic, in the event that it cannot be otherwise implemented;
j) to determine whether a decision to dissolve a political party or other decision relating to the activities of a political party is in conformity with constitutional acts or other laws;
k) to decide jurisdictional disputes between state bodies and bodies of self-governing regions, unless that power is given by statute to another body.
(2) Prior to the ratification of a treaty under Article 10a or Article 49, the Constitutional Court shall further have jurisdiction to decide concerning the treaty’s conformity with the constitutional order. A treaty may not be ratified prior to the Constitutional Court giving judgment.
(3) A statute may provide that, in place of the Constitutional Court, the Supreme Administrative Court shall have jurisdiction:
a) to annul legal enactments other than statutes or individual provisions thereof if they are inconsistent with a statute;
b) to decide jurisdictional disputes between state bodies and bodies of self-governing regions, unless that power is given by statute to another body. (1993 Constitution, Art. 87) - Czech(1) Ústavní soud rozhoduje

i) o opatřeních nezbytných k provedení rozhodnutí mezinárodního soudu, které je pro Českou republiku závazné, pokud je nelze provést jinak,
j) o tom, zda rozhodnutí o rozpuštění politické strany nebo jiné rozhodnutí týkající se činnosti politické strany je ve shodě s ústavními nebo jinými zákony,
k) spory o rozsah kompetencí státních orgánů a orgánů územní samosprávy, nepřísluší-li podle zákona jinému orgánu.
(2) Ústavní soud dále rozhoduje o souladu mezinárodní smlouvy podle čl. 10a a čl. 49 s ústavním pořádkem, a to před její ratifikací. Do rozhodnutí Ústavního soudu nemůže být smlouva ratifikována.
(3) Zákon může stanovit, že namísto Ústavního soudu rozhoduje Nejvyšší správní soud
a) o zrušení právních předpisů nebo jejich jednotlivých ustanovení, jsou-li v rozporu se zákonem,
b) spory o rozsah kompetencí státních orgánů a orgánů územní samosprávy, nepřísluší-li podle zákona jinému orgánu. (Ústava 1993, Čl. 87)

III. Upon request by the President of the Republic of Azerbaijan, the Milli Majlis of the Republic of Azerbaijan, the Cabinet of Ministers of the Republic of Azerbaijan, the Supreme Court of the Republic of Azerbaijan, the General Procurator's Office of the Republic of Azerbaijan or the Ali Majlis of the Nakhichevan Autonomous Republic the Constitutional Court of the Republic of Azerbaijan shall examine the following matters:
1. the conformity with the Constitution of the Republic of Azerbaijan of laws of the Republic of Azerbaijan, decrees and orders of the President of the Republic of Azerbaijan, resolutions of the Milli Majlis of the Republic of Azerbaijan, resolutions and orders of the Cabinet of Ministers of the Republic of Azerbaijan, normative and legal acts of central executive organs of the Republic of Azerbaijan;
2. the conformity with the laws of the Republic of Azerbaijan of decrees of the President of the Republic of Azerbaijan, resolutions of the Cabinet of Ministers of the Republic of Azerbaijan, normative and legal acts of central executive organs of the Republic of Azerbaijan;
3. the conformity with the decrees and orders of the President of the Republic of Azerbaijan of resolutions of the Cabinet of Ministers of the Republic of Azerbaijan and normative and legal acts of central executive organs of the Republic of Azerbaijan;
4. in cases specified by law the conformity of acts of the Supreme Court of the Republic of Azerbaijan with the Constitution and the laws of the Republic of Azerbaijan;
5. the conformity of the acts of the municipalities with the Constitution of the Republic of Azerbaijan, decrees of the President of the Republic of Azerbaijan, resolutions of the Cabinet of Ministers of the Republic of Azerbaijan (in the Nakhichevan Autonomous Republic-also with the Constitution and the laws of the Nakhichevan Autonomous Republic and with the resolutions of the Cabinet of Ministers of the Nakhichevan Autonomous Republic);
6. the conformity of non-ratified inter-state treaties of the Republic of Azerbaijan with the Constitution of the Republic of Azerbaijan and the conformity of intergovernmental treaties with the Constitution and the laws of the Republic of Azerbaijan;
7. the conformity of the Constitution and the laws of the Nakhichevan Autonomous Republic, the resolutions of the Ali Majlis of the Nakhichevan Autonomous Republic, the resolutions and orders of the Cabinet of Ministers of the Nakhichevan Autonomous Republic with the Constitution of the Republic of Azerbaijan, the conformity of the laws of the Nakhichevan Autonomous Republic, the resolutions of the Cabinet of Ministers of the Nakhichevan Autonomous Republic with the laws of the Republic of Azerbaijan, and the conformity of the resolutions of the Cabinet of Ministers of the Nakhichevan Autonomous Republic with the decrees and orders of the President and the resolutions of the Cabinet of Ministers of the Republic of Azerbaijan;
8. disputes related to the separation of powers between the legislative and executive branches.
IV. The Constitutional Court of the Republic of Azerbaijan shall interpret the Constitution and the laws of the Republic of Azerbaijan upon application by the President of the Republic of Azerbaijan, the Milli Majlis of the Republic of Azerbaijan, the Cabinet of Ministers of the Republic of Azerbaijan, the Office of the General Procurator of the Republic of Azerbaijan or the Ali Majlis of the Nakhichevan Autonomous Republic.
V. Everyone who claims to be the victim of a violation of his or her rights or freedoms by a decision of the legislative, executive and judiciary or by one of the municipal acts set forth in the items 1-7 of section of this Article may appeal, in accordance with the procedure provided for by law, to the Constitutional Court of the Republic of Azerbaijan with the view of the restoration of his or her violated human rights and freedoms.
VI. In accordance with the procedure provided by the laws of the Republic of Azerbaijan, courts may apply to the Constitutional Court of the Republic of Azerbaijan for an interpretation of the Constitution and the laws of the Republic of Azerbaijan with regard to issues arising out of the implementation of human rights and civil liberties.
VII. The Ombudsman of the Azerbaijan Republic shall apply to the Constitutional Court of the Republic of Azerbaijan in cases where the rights and freedoms of a person have allegedly been violated by legislative acts in force, normative acts of the executive or of municipalities, or court decisions in accordance with the procedure provided for by the laws of the Republic of Azerbaijan on the adjudication of the cases and applications listed as items 1 to 7 in section III of the present Article.
VIII. The Constitutional Court of the Republic of Azerbaijan shall also perform the other duties specified in the present Constitution.

3) Azərbaycan Respublikası Nazirlər Kabinetinin qərarlarının, mərkəzi icra hakimiyyəti orqanlarının normativ hüquqi aktlarının Azərbaycan Respublikası Prezidentinin fərmanlarına uyğunluğu;
4) Azərbaycan Respublikası Ali Məhkəməsinin qərarlarının qanunda nəzərdə tutulmuş hallarda Azərbaycan Respublikası Konstitusiyasına və qanunlarına uyğunluğu;
5) bələdiyyə aktlarının Azərbaycan Respublikası Konstitusiyasına, Azərbaycan Respublikası qanunlarına, Azərbaycan Respublikası Prezidentinin fərmanlarına, Azərbaycan Respublikası Nazirlər Kabinetinin qərarlarına (Naxçıvan Muxtar Respublikasında həm də Naxçıvan Muxtar Respublikasının Konstitusiyasına, qanunlarına və Naxçıvan Muxtar Respublikası Nazirlər Kabinetinin qərarlarına) uyğunluğu;
6) Azərbaycan Respublikasının qüvvəyə minməmiş dövlətlərarası müqavilələrinin Azərbaycan Respublikası Konstitusiyasına uyğunluğu; Azərbaycan Respublikasının hökumətlərarası müqavilələrinin Azərbaycan Respublikası Konstitusiyasına və qanunlarına uyğunluğu;
7) Naxçıvan Muxtar Respublikası Konstitusiyasının, qanunlarının, Naxçıvan Muxtar Respublikası Ali Məclisinin qərarlarının və Nazirlər Kabinetinin qərarlarının Azərbaycan Respublikası Konstitusiyasına uyğunluğu; Naxçıvan Muxtar Respublikası qanunlarının, Naxçıvan Muxtar Respublikası Nazirlər Kabinetinin qərarlarının Azərbaycan Respublikası qanunlarına uyğunluğu; Naxçıvan Muxtar Respublikası Nazirlər Kabinetinin qərarlarının Azərbaycan Respublikası Prezidentinin fərmanlarına və Azərbaycan Respublikası Nazirlər Kabinetinin qərarlarına uyğunluğu;
8) qanunvericilik, icra və məhkəmə hakimiyyətləri arasında səlahiyyətlər bölgüsü ilə bağlı mübahisələr.
IV. Azərbaycan Respublikasının Konstitusiya Məhkəməsi Azərbaycan Respublikası Prezidentinin, Azərbaycan Respublikası Milli Məclisinin, Azərbaycan Respublikası Nazirlər Kabinetinin, Azərbaycan Respublikası Ali Məhkəməsinin, Azərbaycan Respublikası Prokurorluğunun, Naxçıvan Muxtar Respublikası Ali Məclisinin sorğusu əsasında Azərbaycan Respublikasının Konstitusiyasını və qanunlarını şərh edir.
V. Hər kəs onun hüquq və azadlıqlarını pozan qanunvericilik və icra hakimiyyəti orqanlarının normativ aktlarından, bələdiyyə və məhkəmə aktlarından qanunla müəyyən edilmiş qaydada bu maddənin III hissəsinin 1-7-ci bəndlərində göstərilən məsələlərin Azərbaycan Respublikasının Konstitusiya Məhkəməsi tərəfindən həll edilməsi üçün Azərbaycan Respublikasının Konstitusiya Məhkəməsinə pozulmuş insan hüquq və azadlıqlarının bərpa edilməsi məqsədi ilə şikayət verə bilər.
VI. Azərbaycan Respublikasının qanunları ilə müəyyən edilmiş qaydada məhkəmələr insan hüquq və azadlıqlarının həyata keçirilməsi məsələləri ilə bağlı Azərbaycan Respublikası Konstitusiyasının və qanunlarının şərh edilməsi haqqında Azərbaycan Respublikasının Konstitusiya Məhkəməsinə müraciət edə bilərlər.
VII. Azərbaycan Respublikasının İnsan hüquqları üzrə müvəkkili insan hüquq və azadlıqlarını pozan qanunvericilik və icra hakimiyyəti orqanlarının normativ aktlarından, bələdiyyə və məhkəmə aktlarından qanunla müəyyən edilmiş qaydada bu maddənin III hissəsinin 1-7-ci bəndlərində göstərilən məsələlərin Azərbaycan Respublikasının Konstitusiya Məhkəməsi tərəfindən həll edilməsi üçün Azərbaycan Respublikasının Konstitusiya Məhkəməsinə sorğu verə bilər.

– decide on the constitutionality of the laws and of the regulatory acts taken in the matters other than those arising within the domain of the law;
– assure the respect for this Constitution including the Charte des Droits fundamentaux [Charter of Fundamental Rights], by the organs of the State, [and] the other institutions;
– interpret the Constitution, at the demand of the President of the Republic, of the President of the National Assembly, of the President of the Senate, of one-quarter of the Deputies or of one-quarter of the Senators;
– decide on the regularity of the presidential elections, legislative [elections] and of the referenda and to proclaim the definitive results of them;
– receive the oath of the President of the Republic, of the Vice President of the Republic, of the Prime Minister and of the other Ministers before their entry into [their] functions;
– declare the vacancy of the post of President of the Republic.

Amabwirizwa yunganira Ibwirizwa Shingiro imbere y’uko atangazwa, amasezerano mpuzamakungu imbere yuko ashikirizwa Inama Nshingamateka n’Inama Nkenguzamateka ngo ziyemeze, amategeko ntunganyabikorwa atomora ingene Inama Nshingamateka n’ingene Inama Nkenguzamateka zitunganiriza imirimo yazo, ategerezwa gusuzumwa na Sentare yubahiriza Ibwirizwa Shingiro imbere y’uko atangazwa. (Ingingo ya 234) - FrenchLa Cour Constitutionnelle est compétente pour :
- statuer sur la constitutionnalité des lois et des actes réglementaires pris dans les matières autres que celle relevant du domaine de la loi ;
- assurer le respect de la présente Constitution y compris la Charte des Droits fondamentaux, par les organes de l’Etat, les autres institutions ;
- interpréter la Constitution, à la demande du Président de la République, du Président de l’Assemblée Nationale, du Président du Sénat, d’un quart des députés ou d’un quart des sénateurs ;
- statuer sur la régularité des élections présidentielles et législatives et des référendums et en proclamer les résultats définitifs ;
- recevoir le serment du Président de la République, du Vice-Président de la République, du Premier Ministre et des autres Ministres avant leur entrée en fonctions ;
- constater la vacance du poste de Président de la République ;
- constater la vacance des sièges des parlementaires.
Les lois organiques avant leur promulgation, les traités internationaux avant de les soumettre au vote des Assemblées, les règlements intérieurs de l’Assemblée Nationale et du Sénat avant leur mise en application, sont soumis obligatoirement au contrôle de constitutionnalité. (Art. 234)
