Obligations of the State

The State and other public entities shall be civilly liable for acts or omissions performed by their agents in the exercise of their public functions or as a result of the latter, and that, by any means, violate rights, liberties and guarantees to the detriment of the holder or third parties of such.
2. Agents of the State and of other public entities shall be criminally and disciplinarily responsible, under the terms of the law, for acts or omissions that result in the violation of rights, liberties and guarantees. - EnglishEveryone whose constitutional rights and freedoms have been violated has the right to request prompt access to the competent authorities.
The State is obliged to indicate in its proceedings, the legal remedies and authorities the persons concerned should apply and time limits of the applications.
Damages incurred to any person through unlawful treatment by public officials shall be compensated for by the State as per the law. The state reserves the right of recourse to the official responsible.
