The laws prior to the Constitution must be modified, if it applies, to render them in conformity with the constitutional rights and freedoms within a time period not exceeding three years counting from the date of promulgation of this Constitutional Law.
In case that the modifications provided for in the preceding paragraph are not adopted [apportées] in the prescribed times, any individual can refer [déférer] these laws to the Constitutional Council for examination of their constitutionality. Les lois antérieures à la Constitution doivent être modifiées, s’il y a lieu, pour les rendre conformes aux droits et libertés constitutionnels, dans un délai n’excédant pas trois (3) ans pour compter de la date de promulgation de la présente loi constitutionnelle.
Au cas où les modifications prévues à l'alinéa précédent ne sont pas apportées dans les délais prescrits, tout individu pourra déférer ces lois au Conseil constitutionnel pour examen de leur constitutionnalité. Les dispositions déclarées inconstitutionnelles ne peuvent être appliquées. (Art. 102)

- EnglishThe special proceedings for protection shall be admissible against those rulings or definitive judgments where there has been a violation, by deed or omission, of the rights enshrined in the Constitution, and they shall be filed with the Constitutional Court. This appeal shall be admissible when regular and special appeals have been exhausted within the legal framework, unless the failure to file these resources was not attributable to the negligence of the person bearing the constitutional right that was infringed. Injured parties may, without prior authorization, appeal to the competent courts, to bring suit against the authors and perpetrators of these arbitrary acts, regardless of their rank or the body to which they belong. (a) The Constitutional Court, if the challenge is directed at any infringement of the constitutional order or constitutional freedoms, protections or rights.

- EnglishAll persons that for an act or an omission, manifestly illegitimate, of an authority or of a particular [person], consider themselves gravely affected, or in imminent danger to become so in rights and guarantees consecrated in this Constitution or in the law, and that due to the urgency of the case may not be remedied through the ordinary way [via], may promote amparo before the competent magistrate.
The procedure will be brief, summary, gratuitous and of popular action for the cases specified by the law.
The magistrate will have the faculty to safeguard the right or guarantee, or to immediately restore[,] the infringed juridical situation.

- English(1) Subsection (2) applies in any proceedings in which a court determines whether a provision of primary legislation is compatible with a Convention right.
(2) If the court is satisfied that the provision is incompatible with a Convention right, it may make a declaration of that incompatibility.
(3) Subsection (4) applies in any proceedings in which a court determines whether a provision of subordinate legislation, made in the exercise of a power conferred by primary legislation, is compatible with a Convention right.
(4) If the court is satisfied—
(a) that the provision is incompatible with a Convention right, and
(b) that (disregarding any possibility of revocation) the primary legislation concerned prevents removal of the incompatibility, it may make a declaration of that incompatibility.
(5) In this section “court” means—
(a) the Supreme Court;
(b) the Judicial Committee of the Privy Council;
(c) the Court Martial Appeal Court;
(d) in Scotland, the High Court of Justiciary sitting otherwise than as a trial court or the Court of Session;
(e) in England and Wales or Northern Ireland, the High Court or the Court of Appeal.
(f) the Court of Protection, in any matter being dealt with by the President of the Family Division, the Chancellor of the High Court or a puisne judge of the High Court. (Human Rights Act 1998, Sec. 4)10
