- EnglishDuring a state of emergency, the President may, by law or orders, take any measures that shall not derogate from the provisions of this Constitution except as provided herein:
a. to suspend part of the Bill of Rights. However, there shall be no infringement on the right to life, prohibition against slavery, prohibition against torture, the right of non-discrimination on the basis of race, sex, religious creed, the right to litigation or the right to fair trial;
b. to dissolve or suspend any institution of the National Executive;
c. to dissolve or suspend any of the state organs or suspend such powers conferred upon the states under this Constitution; and
d. to take any such measures as deemed necessary to the state of emergency, which shall have the force of law. (Art. 190)

Limitations and/or Derogations
- English(1) In addition to the limitations permitted by section 86, the fundamental rights and freedoms set out in this Chapter may be further limited by a written law providing for measures to deal with situations arising during a period of public emergency, but only to the extent permitted by this section and the Second Schedule.10
(2) A written law referred to in subsection (1) and any legislative measures taken under that law, must be published in the Gazette.
(3) Any limitation which a written law referred to in subsection (1) imposes on a fundamental right or freedom set out in this Chapter must not be greater than is strictly required by the emergency.
(4) No law that provides for a declaration of a state of emergency, and no legislative or other measure taken in consequence of such a declaration, may—
(a) indemnify, or permit or authorise an indemnity for, the State or any institution or agency of the government at any level, or any other person, in respect of any unlawful act; or
(b) limit any of the rights referred to in section 86(3), or authorise or permit any of those rights to be violated. (Sec. 87)
Limitations and/or Derogations
- English1. The exercise of the rights, freedoms and guarantees of citizens may only be limited or suspended in the event of a state of war, siege or emergency, under the terms of the Constitution and the law.
2. A state of war, siege or emergency may only be declared in part or all of national territory in cases of actual or imminent aggression by foreign forces, serious threat to, or disturbance of, the constitutional democratic order, or public disaster.
3. The decision to opt for a state of war, siege or emergency, in addition to its declaration and implementation must always be limited to the necessary and appropriate actions required to maintain public order and protect general interests, observing the principle of proportionality and being limited, particularly with regard to extent and duration and the means employed, to that which is strictly necessary to promptly restore constitutional normality.
4. The declaration of a state of war, siege or emergency shall confer on the public authorities the power and responsibility to take the appropriate steps needed to restore constitutional normality.
5. Under no circumstances may the declaration of a state of war, siege or emergency effect:
a) The application of constitutional rules concerning the responsibilities and functioning of the bodies that exercise sovereign power;
b) The rights and immunities of the members of bodies that exercise sovereign power;
c) The right to life, personal integrity and personal identity;
d) Civil capacity and citizenship;
e) The non-retroactive nature of criminal law;
f) The right to a defence;
g) Freedom of conscience and religion.
6. Special law shall regulate the state of war, siege or emergency. (Art. 58) - Portuguese1. O exercício dos direitos, liberdades e garantias dos cidadãos apenas pode ser limitado ou suspenso em caso de estado de guerra, de estado de sítio ou de estado de emergência, nos termos da Constituição e da lei.
2. O estado de guerra, o estado de sítio e o estado de emergência só podem ser declarados, no todo ou em parte do território nacional, nos casos de agressão efectiva ou iminente por forças estrangeiras, de grave ameaça ou perturbação da ordem constitucional democrática ou de calamidade pública.
3. A opção pelo estado de guerra, estado de sítio ou estado de emergência, bem como a respectiva declaração e execução, devem sempre limitar-se às acções necessárias e adequadas à manutenção da ordem pública, à protecção do interesse geral, ao respeito do princípio da proporcionalidade e limitar-se, nomeadamente quanto à sua extensão, duração e meios utilizados, ao estritamente necessário ao pronto restabelecimento da normalidade constitucional.
4. A declaração do estado de guerra, do estado de sítio ou do estado de emergência confere às autoridades competência para tomarem as providências necessárias e adequadas ao pronto restabelecimento da normalidade constitucional.
5. Em caso algum a declaração do estado de guerra, do estado de sítio ou do estado de emergência pode afectar:
a) A aplicação das regras constitucionais relativas à competência e ao funcionamento dos órgãos de soberania;
b) Os direitos e imunidades dos membros dos órgãos de soberania;
c) O direito à vida, à integridade pessoal e à identidade pessoal;
d) A capacidade civil e a cidadania;
e) A não retroactividade da lei penal;
f) O direito de defesa dos arguidos;
g) A liberdade de consciência e de religião.
6. Lei especial regula o estado de guerra, o estado de sítio e o estado de emergência. (Art. 58)
Limitations and/or Derogations
- English1. Suspension of the exercise of fundamental rights, freedoms and guarantees shall only take place if a state of siege or a state of emergency has been declared as provided for by the Constitution.
2. A state of siege or a state of emergency shall only be declared in case of effective or impending aggression by a foreign force, of serious disturbance or threat of serious disturbance to the democratic constitutional order, or of public disaster.
3. A declaration of a state of siege or a state of emergency shall be substantiated, specifying rights, freedoms and guarantees the exercise of which is to be suspended.
4. A suspension shall not last for more than thirty days, without prejudice of possible justified renewal, when strictly necessary, for equal periods of time.
5. In no case shall a declaration of a state of siege affect the right to life, physical integrity, citizenship, non-retroactivity of the criminal law, defence in a criminal case and freedom of conscience and religion, the right not to be subjected to torture, slavery or servitude, the right not to be subjected to cruel, inhuman or degrading treatment or punishment, and the guarantee of non-discrimination.

A suspensão do exercício dos direitos, liberdades e garantias fundamentais só pode ter lugar declarado o estado de sítio ou o estado de emergência nos termos previstos na Constituição.
2. O estado de sítio ou o estado de emergência só podem ser declarados em caso de agressão efectiva ou iminente por forças estrangeiras, de grave perturbação ou ameaça de perturbação séria da ordem constitucional democrática ou de calamidade pública.
3. A declaração do estado de sítio ou do estado de emergência é fundamentada, com especificação dos direitos, liberdades e garantias cujo exercício fica suspenso.
4. A suspensão não pode prolongar-se por mais de trinta dias, sem impedimento de eventual renovação fundamentada por iguais períodos de tempo, quando absolutamente necessário.
5. A declaração do estado de sítio em caso algum pode afectar os direitos à vida, integridade física, cidadania e não retroactividade da lei penal, o direito à defesa em processo criminal, a liberdade de consciência e de religião, o direito a não ser sujeito a tortura, escravatura ou servidão, o direito a não ser sujeito a tratamento ou punição cruel, desumano ou degradante e a garantia de não discriminação.
6. As autoridades estão obrigadas a restabelecer a normalidade constitucional no mais curto espaço de tempo. (Art. 25)

- EnglishIn the event of domestic disorder or foreign attack endangering the full enforcement of this Constitution and of the authorities hereby established, the province or territory which is in a turmoil shall be declared in state of siege and the constitutional guarantees shall be suspended therein. But during such a suspension the President of the Republic shall not pronounce judgment or apply penalties on his own. In such case, his power shall be limited, with respect to persons, to their arrest or transfer from one place of the Nation to another, should they not prefer to leave the Argentine territory.
