The National Elections Commission is an independent authority and shall be solely competent to administer referenda and elections of the president, the parliament and the local councils. Such administration shall include the development and updating of a database for voters, proposing the division of constituencies, determination of controls for promotion and funding of electoral campaigns, as well as electoral expenditure, the disclosure of such expenditure, the supervision of such controls, the facilitation of the procedures for out-of-country voting by expatriate Egyptians, and other procedures till the announcements of the results.
The foregoing shall be regulated by law. (Art. 208)

1. The Electoral Supervisory Commission shall have general responsibility for and shall supervise, the registration of electors for the election of members of the Assembly and the conduct of elections of such members and the Commission shall have such powers and other functions relating to such registration and such elections as may be prescribed.
2. The Electoral Commissioner shall have such powers and other functions relating to such registration and elections as may be prescribed, and he shall keep the Electoral Supervisory Commission fully informed concerning the exercise of his functions and shall have the right to attend meetings of the Commission and to refer to the Commission for their advice or decision any question relating to his functions.

(1) Independent commissions shall be established, and figures with attested competence and integrity shall be nominated therefor. They are formed and their competencies defined by the laws that establish them.

A supplementary law shall provide for the organization and competence of the electoral courts, judges and boards.

Everything that is related to the exercise of suffrage, the political rights, [the] political organizations, [the] electoral authorities and organs and the electoral process, will be regulated by the constitutional law of the matter.

The renewal of the Legislative and Executive powers will be realized by way of free, authentic and periodic elections, in accordance with the following bases:

V. The organization of the elections is a state function that is realized through the National Electoral Institute and the local public organs, in the terms that this Constitution establishes.
Part A. The National Electoral Institute is an autonomous public organ endowed with juridical personality and its own patrimony, in the composition of which the Legislative Power of the Union, the national political parties and the citizens participate, in the terms that the law orders. In the exercise of this state function, certainty [certeza], legality, independence, impartiality, maximum publicity and objectivity shall be guiding [rectores] principles.

(1) The superintendence, direction and control of the preparation of the electoral rolls for, and the conduct of, all elections to Parliament and to the Legislature of every State and of elections to the offices of President and Vice-President held under this Constitution shall be vested in the Election Commission.
(2) The Election Commission shall consist of the Chief Election Commissioner and such number of other Election Commissioners, if any, as the President may from time to time fix and the appointment of the Chief Election Commissioner and other Election Commissioners shall, subject to the provisions of any law made in that behalf by Parliament, be made by the President.

There shall be an Electoral Court which shall have the following powers in addition to those established in Section III or which may be prescribed by law:
a. To act in all matters relating to electoral acts or procedures;
b. To exercise directive, disciplinary, advisory, and economic supervision over electoral organs;
c. To render final decision on all appeals and claims that may arise and act as judge of the elections to all elective offices, and of plebiscites and referendums. (Art. 322)

The Commission may, during the election period, supervise or regulate the enjoyment or utilization of all franchises or permits for the operation of transportation and other public utilities, media of communication or information, all grants, special privileges, or concessions granted by the Government or any subdivision, agency, or instrumentality thereof, including any government-owned or controlled corporation or its subsidiary. Such supervision or regulation shall aim to ensure equal opportunity, time, and space, and the right to reply, including reasonable, equal rates therefor, for public information campaigns and forums among candidates in connection with the objective of holding free, orderly, honest, peaceful, and credible elections. (1) There shall be an Electoral Commission for Malta.

(9) In the exercise of its functions under this Constitution the Electoral Commission shall not be subject to the direction or control of any other person or authority. (Art. 60)
