- EnglishMarriage is a social and legal institution. It is one of the organizational structures of families. It is based on free consent and on the equality of rights, obligations, and legal capacity of spouses.
The law determines how they are constituted and their effects.
Furthermore, it recognizes the stable and singular union with legal capacity that effectively forms a common life plan that, under the conditions and circumstances indicated in the law, generates the rights and obligations that the law provides. Venezuela, Bolivarian Republic of
- EnglishThe State shall protect families as a natural association in society, and as the fundamental space for the overall development of persons. Family relationships are based on equality of rights and duties, solidarity, common effort, mutual understanding and reciprocal respect among family members. The State guarantees protection to the mother, father or other person acting as head of a household. Children and adolescents have the right to live, be raised and develop in the bosom of their original family. When this is impossible or contrary to their best interests, they shall have the right to a substitute family, in accordance with law.
Adoption has effects similar to those of parenthood, and is established in all cases for the benefit of the adoptee, in accordance with law. International adoption shall be subordinated to domestic adoption. Cabo Verde
- English1. Everyone shall have the right to enter into matrimony, in civil or religious form.
2. The law shall regulate the requirements, the civil effects of marriage and its dissolution, irrespective of the form of its celebration.
3. Spouses shall have equal civil and political rights and duties.
4. Children shall only be separated from their parents through judicial decision and strictly in cases foreseen in the law, should the parents not comply with their fundamental duties towards them.
5. The discrimination against children born out of wedlock or the use of any discriminatory designation with respect to parenting shall not be allowed.
6. Adoption shall be allowed, with the law regulating its forms and conditions. (Art. 47) - Portuguese1. Todos têm direito de contrair casamento, sob forma civil ou religiosa.
2. A lei regula os requisitos e os efeitos civis do casamento e da sua dissolução, independentemente da forma de celebração.
