- English1. Subject to subsections (4), (5) and (7), no law shall make any provision that is discriminatory either of itself or in its effect.

In this section, 'discriminatory" means affording different treatment to different persons attributable wholly or mainly to their respective descriptions by race, caste, place of origin, political opinions, colour, creed or sex whereby persons of one such description are subjected to disabilities or restrictions to which persons of another such description are not made subject or are accorded privileges or advantages that are not accorded to persons of another such description.
4. Subsection (1) shall not apply to any law so far as that law makes provision –

- English(1) The State shall not discriminate against any citizen on ground only of religion, race, caste, sex or place of birth.
(2) Women shall have equal rights with men in all spheres of the State and of public life.
(3) No citizen shall, on grounds only of religion, race, caste, sex or place of birth be subjected to any disability, liability, restriction or condition with regard to access to any place of public entertainment or resort, or admission to any educational institution.
(4) Nothing in this article shall prevent the State from making special provision in favour of women or children or for the advancement of any backward section of citizens. (৪) নারী বা শিশুদের অনুকূলে কিংবা নাগরিকদের যে কোন অনগ্রসর অংশের অগ্রগতির জন্য বিশেষ বিধান-প্রণয়ন হইতে এই অনুচ্ছেদের কোন কিছুই রাষ্ট্রকে নিবৃত্ত করিবে না। (অনুচ্ছেদ ২৮)
