In the case of referral [of a matter] to the Constitutional Council by way of action, a law or a provision declared contrary to the Constitution[,] it may not be promulgated or applied. The law or the provision contrary to the Constitution is null with respect to all.
In the case of referral [of a matter] to the Constitutional Council by way of pleadings [exception], the decision of the Constitutional Council is imposed on all, beyond the parties or the process. The law or the provision declared unconstitutional by the Constitutional Council is abrogated.
