Limitations and/or Derogations
- English1. The laws that deny or derogate human and civil rights and freedoms shall not be adopted in the Kyrgyz Republic.
2. Human and civil rights and freedoms may be limited by the Constitution and laws for the purposes of protecting national security, public order, health and morale of the population as well as rights and freedoms of other persons. Such limitations can be also introduced in view of specific modalities of military or other civil service. The introduced limitations should be commensurate to the declared objectives.
The adoption of by-law regulatory acts which limit human and civil rights and freedoms is prohibited.
3. A law may not impose the limitation of rights and freedoms with other objective and to a greater extent than it is envisaged in the Constitution.
4. The following guarantees of prohibition established by the present Constitution shall not be subject to any limitations:
1. On application of death penalty, torture and other inhuman, cruel and degrading forms of treatment or punishment;
2. On conducting of medical, biological or psychological experiments on people without their duly expressed and verified voluntary consent;
3. On slavery and human trafficking;
4. On exploitation of child labor;
5. On deprivation of freedom solely for the inability of a person to meet the contractual obligation;
6. On criminal prosecution for the dissemination of information which encroaches on honor and dignity of a person;
7. On coercion to express opinions, religious or other beliefs or denial thereof;
8. On coercion to participate in a peaceful assembly;
9. On coercion to determine and state one's ethnicity;
10. On arbitrary deprivation of housing.
5. The following rights established in the present Constitution, shall not be subject to any limitation whatsoever:
1. That of each detained person to human treatment and respect of human dignity;
2. That of appeal to pardon or alleviation of punishment;
3. That of repeated consideration of the case by a higher court;
4. That of freedom of thought and opinion;
5. That of freedom of choice and possessing religious or other beliefs;
6. That of freedom to determine and state one's ethnicity;
7. That of compensation by their state of harm caused by illegal actions of state authorities, local self-governance bodies and officials thereof in their official capacity;
8. That of judicial protection;
9. That of free basic general and secondary general education in state educational establishments;
10. That of a citizen to unimpeded return to the Kyrgyz Republic. (Art. 20) - Russian1. В Кыргызской Республике не должны приниматься законы, отменяющие или умаляющие права и свободы человека и гражданина.
2. Права и свободы человека и гражданина могут быть ограничены Конституцией и законами в целях защиты национальной безопасности, общественного порядка, охраны здоровья и нравственности населения, защиты прав и свобод других лиц. Вводимые ограничения должны быть соразмерными указанным целям.
Запрещается принятие подзаконных нормативных правовых актов, ограничивающих права и свободы человека и гражданина.
3. Законом не могут устанавливаться ограничения прав и свобод в иных целях и в большей степени, чем это предусмотрено Конституцией.
4. Не подлежат никаким ограничениям установленные настоящей Конституцией гарантии запрета:
1) на применение смертной казни, пыток и других бесчеловечных, жестоких или унижающих достоинство видов обращения или наказания;
2) на проведение медицинских, биологических, психологических опытов над людьми без их добровольного согласия, выраженного и удостоверенного надлежащим образом;
3) на рабство, торговлю людьми;
4) на эксплуатацию детского труда;
5) на лишение свободы на том только основании, что лицо не в состоянии исполнить договорное обязательство;
6) на уголовное преследование за распространение информации, порочащей честь и достоинство личности;
7) на принуждение к выражению мнения, религиозных и иных убеждений или отказу от них;
8) на принуждение к участию в мирном собрании;
9) на принуждение к определению и указанию своей этнической принадлежности;
10) на произвольное лишение жилища.
5. Не подлежит никакому ограничению установленное настоящей Конституцией право:
1) каждого лишенного свободы на гуманное обращение и уважение человеческого достоинства;
2) просить о помиловании или смягчении наказания;
3) на повторное рассмотрение дела вышестоящим судом;
4) на свободу мысли и мнения;
5) свободно выбирать и иметь религиозные и иные убеждения;
6) свободно определять и указывать свою этническую принадлежность;
7) на возмещение государством вреда, причиненного незаконными действиями органов государственной власти, местного самоуправления и их должностными лицами при исполнении служебных обязанностей;
8) на судебную защиту;
9) на бесплатное получение основного общего и среднего общего образования в государственных образовательных организациях;

2. Limitations and/or Derogations
- English(1) Any law enacted or promulgated in consequence of a declaration of a state of emergency under this Constitution—
(a) may limit a right or freedom set out in this Chapter (with the exception of the rights and freedoms set out in sections 8, 10, 11, 13, 14, 15, 16, 22 and 26) only to the extent that—
(i) the limitation is strictly necessary and required by the emergency; and
(ii) the law is consistent with Fiji’s obligations under international law applicable to a state of emergency; and
(b) takes effect only when it has been published in the Gazette.
(2) A person detained under a law contemplated in subsection (1) retains all the rights recognised in this Chapter, subject only to the limitations referred to in subsection (1). Limitations and/or Derogations
- EnglishIn cases of war, invasion of the territory, rebellion, sedition, catastrophe, epidemic, or other general calamity, or of serious disturbances to the public order, the guarantees established in Articles 5, 6 [in its] first paragraph, 7 [in its] first paragraph and 24 of this Constitution can be suspended, except when dealing with meetings or associations with religious, cultural, economic or sport purposes. Such suspension can affect all or part of the territory of the Republic, and will be conducted by means of a decree of the Legislative Organ or [of] the Executive Organ, as the case may be.
There can also be the suspension of the guarantees contained in Articles 12 [in its] second paragraph and 13 [in its] second paragraph of this Constitution, when agreed to as such by the Legislative Organ, with the favorable vote of the threefourths part of the elected Deputies; not exceeding the administrative detention of fifteen days. 1. Extraordinary measures may be imposed due to a state of war, state of emergency, or state of natural disaster and last for as long as these states continue.
2. The principles of the activity of public bodies, as well as the extent of limitations on human rights and freedoms during the period of the existence of situations that require extraordinary measures, are defined by law.
3. The law must define the principles, areas and manner of compensation for losses caused as a result of the limitation of human rights and freedoms during the period in which extraordinary measures are imposed.
4. Acts taken as a result of extraordinary measures shall be in proportion with the level of risk and shall aim to re-establish the conditions for the normal functioning of the state, as soon as possible.
5. During the situations that require the imposition of extraordinary measures, none of these acts may be amended: the Constitution, the laws on the election of the Assembly and organs of local government, as well as the laws on extraordinary measures.
6. During the period of implementation of extraordinary measures, there may not be held elections for local government bodies, there may not be a referendum, and a new President of the Republic may not be elected. The elections for the local government bodies may be held only in those places where the extraordinary measures are not implemented. (Art. 170) - Albanian

5. Gjatë gjendjeve që kërkojnë marrjen e masave të jashtëzakonshme, nuk mund të ndryshohet asnjë prej këtyre akteve: Kushtetuta, ligjet për zgjedhjet për Kuvendin dhe për organet e pushtetit vendor, si dhe ligjet për masat e jashtëzakonshme.
6. Gjatë periudhës së zbatimit të masave të jashtëzakonshme nuk mund të zhvillohen zgjedhje vendore, nuk mund të zhvillohet referendum, si dhe nuk mund të zgjidhet një President i ri i Republikës. Zgjedhjet vendore mund të bëhen vetëm aty ku nuk zbatohen masat e jashtëzakonshme. (Neni 170)
