- English1. In cases submitted for trial, tribunals may not apply rules that contravene the Constitution or the principles enshrined therein.
2. Matters of unconstitutionality may be raised by the tribunal of its own motion, by the Public Attorney’s Office, or by any of the parties.
3. After acknowledging the matter of unconstitutionality, the incident will be separately submitted to the Superior Tribunal of Justice, which will decide in a plenary session.

- EnglishThe Court of Constitutionality has the following functions:
a. To take cognizance in sole [unique] instance of the challenges interposed against the laws or provisions of general character, objected to for partial or total unconstitutionality;
b. To take cognizance in sole instance in its status of Extraordinary Tribunal of [the recourse of] amparo, of actions of amparo interposed against the Congress of the Republic, the Supreme Court of Justice, [or] the President or [the] Vice-President of the Republic;
c. To take cognizance on appeal of all [recourses of] amparo interposed before any of the tribunals of justice. If the appeal should be against a resolution of amparo of the Supreme Court of Justice, the Court of Constitutionality shall be expanded by two members [vocales] in the form specified in Article 268;
d. To take cognizance on appeal of all the challenges against the laws objected to for unconstitutionality in specific cases, in any trial, in cassation, or in the cases contemplated by the law in the matter;
e. To issue an opinion regarding the constitutionality of treaties, agreements, and bills of law at the request of any of the organs of the State;
f. To take cognizance and resolve [the] issues concerning to any conflict of jurisdiction in matters of constitutionality;
g. To compile the doctrine and constitutional principles that have been invoked with the purpose of resolving them through [the recourse of] amparo and [through the recourse] of unconstitutionality of the laws, [and] maintain the jurisprudential bulletin or gazette;
h. To issue an opinion on the unconstitutionality of the laws vetoed by the Executive alleging unconstitutionality; and
i. To act, to render opinions [opinar], to dictate, or to take cognizance of those matters under its competence established in the Constitution of the Republic. (Art. 272) - SpanishLa Corte de Constitucionalidad tiene las siguientes funciones:
a) Conocer en única instancia de las impugnaciones interpuestas contra leyes o disposiciones de carácter general, objetadas parcial o totalmente de inconstitucionalidad;
b) Conocer en única instancia en calidad de Tribunal Extraordinario de Amparo en las acciones de amparo interpuestas en contra del Congreso de la República, la Corte Suprema de Justicia, el Presidente y el Vicepresidente de la República;

f) Conocer y resolver lo relativo a cualquier conflicto de jurisdicción en materia de constitucionalidad;
g) Compilar la doctrina y principios constitucionales que se vayan sentando con motivo de las resoluciones de amparo y de inconstitucionalidad de las leyes, manteniendo al día el boletín o gaceta jurisprudencial;
h) Emitir opinión sobre la inconstitucionalidad de las leyes vetadas por el Ejecutivo alegando inconstitucionalidad; e
i) Actuar, opinar, dictaminar o conocer de aquellos asuntos de su competencia establecidos en la Constitución de la República. (Art. 272)

(3) The Court of Appeal has jurisdiction, subject to this Constitution and to such requirements as prescribed by written law, to hear and determine appeals from all judgments of the High Court, and has such other jurisdiction as is conferred by written law.

An appeal shall lie as of right to the Judicial Committee from any decision of the High Court involving the interpretation of this Constitution in any proceedings in which application has been made to the High Court alleging that any provision of this Constitution has been contravened and the rights or interests of any Banaban or of the Rabi Council under this Chapter or Chapter III are being or are likely to be affected by such contravention.

The laws prior to the Constitution must be modified, if it applies, to render them in conformity with the constitutional rights and freedoms within a time period not exceeding three years counting from the date of promulgation of this Constitutional Law.
In case that the modifications provided for in the preceding paragraph are not adopted [apportées] in the prescribed times, any individual can refer [déférer] these laws to the Constitutional Council for examination of their constitutionality. Les lois antérieures à la Constitution doivent être modifiées, s’il y a lieu, pour les rendre conformes aux droits et libertés constitutionnels, dans un délai n’excédant pas trois (3) ans pour compter de la date de promulgation de la présente loi constitutionnelle.
Au cas où les modifications prévues à l'alinéa précédent ne sont pas apportées dans les délais prescrits, tout individu pourra déférer ces lois au Conseil constitutionnel pour examen de leur constitutionnalité. Les dispositions déclarées inconstitutionnelles ne peuvent être appliquées. (Art. 102)

- EnglishAmong the constitutional and legal functions of the Supreme Court of Justice shall be the following:
1. To guard the integrity of the Constitution. For this purpose, and after hearing the opinion of the Attorney General of the Nation or the Solicitor General of the Administration, the Court in plenary session shall try and rule on cases concerning the unconstitutionality of laws, decrees, decisions, resolutions and other acts that for reasons of substance or form are challenged before it, by any person.
When during the proceedings of a case, the public official entrusted with the administration of Justice considers, or it is observed by one of the parties, that the legal or regulatory provision applicable to the case is unconstitutional, he/she shall submit the question to the cognizance of the Court in plenary session, except when the provision has already been the subject of a decision, and shall order a continuance of the case, until the question of constitutionality is decided.
The parties only shall be able to formulate such observations one time during the process of a case;
… (Art. 206) - SpanishLa Corte Suprema de Justicia tendrá, entre sus atribuciones constitucionales y legales, las siguientes:
1. La guarda de la integridad de la Constitución para lo cual la Corte en pleno conocerá y decidirá, con audiencia del Procurador General de la Nación o del Procurador de la Administración, sobre la inconstitucionalidad de las Leyes, decretos, acuerdos, resoluciones y demás actos que por razones de fondo o de forma impugne ante ella cualquier persona.
Cuando en un proceso el funcionario público encargado de impartir justicia advirtiere o se lo advirtiere alguna de las partes que la disposición legal o reglamentaria aplicable al caso es inconstitucional, someterá la cuestión al conocimiento del pleno de la Corte, salvo que la disposición haya sido objeto de pronunciamiento por parte de ésta, y continuará el curso del negocio hasta colocarlo en estado de decidir.
Las partes sólo podrán formular tales advertencias una sola vez por instancia.

- EnglishThe President of the Republic, the two political party groups having the largest number of members in the Grand National Assembly of Turkey, and at least one-fifth of the total number of members of the Grand National Assembly of Turkey shall have the right to apply for annulment action directly to the Constitutional Court, based on the assertion of the unconstitutionality, in form and in substance, of laws, of presidential decrees, of Rules of Procedure of the Grand National Assembly of Turkey or of certain articles or provisions thereof. (1) Subject to subsection (2), the High Court has original jurisdiction to determine any question as to the interpretation or application of this Constitution.
(2) Where —
(a) any question as to the interpretation or application of this Constitution arises in any proceedings in a subordinate court; and
(b) that court is of the opinion that the question involves a substantial question of law,
the court may, and shall if a party to the proceedings so requests, refer the question to the High Court for determination. (Sec. 134)
