Obligations of the State
- EnglishThe recitation of rights and guarantees contained in this Constitution and in international instruments concerning human rights are not to be understood as negating others inherent to individuals, not expressly mentioned in such recitation. The absence of a law regulating these rights shall not adversely affect the exercise thereof. (Art. 22)

- English(1) The fundamental rights and freedoms recognized in this Chapter4 shall always be respected in the making and application of the law. Likewise, they must be respected by all individuals and private organisations, as well as by every state institution and state official as they carry out their official functions.
(2) It is the responsibility of the state not only to ensure it does not violate rights through its actions, but also to take reasonable steps to protect the rights of the people from abuse by others.
(3) The rights recognized in this Chapter may be limited only by a law as provided for in Article 38. - EnglishAll of the people shall be respected as individuals. Their right to life, liberty, and the pursuit of happiness shall, to the extent that it does not interfere with the public welfare, be the supreme consideration in legislation and in other governmental affairs. (Art. 13)

The National Assembly or any subordinate legislative authority shall not make any law, and the Executive and the agencies of government shall not take any action that abolishes or abridges the fundamental rights and freedoms conferred by this Constitution, unless so authorised by this Constitution. - EnglishI. The rights recognized in this Constitution are inviolable, universal, interdependent, indivisible and progressive. The State has the duty to promote, protect and respect them.
II. The rights declared in this Constitution shall not be understood to deny other rights that are not enumerated.
III. The classification of the rights established in this Constitution does not determine any hierarchy or superiority of some rights over others.
IV. International treaties and conventions ratified by the Pluri-National Legislative Assembly (Asamblea Legislativa), which recognize human rights and prohibit their limitation in States of Emergency, prevail over internal law. The rights and duties consecrated in this Constitution shall be interpreted in accordance with the International Human Rights Treaties ratified by Bolivia. (Art. 13) - SpanishI. Los derechos reconocidos por esta Constitución son inviolables, universales, interdependientes, indivisibles y progresivos. El Estado tiene el deber de promoverlos, protegerlos y respetarlos.
