- English1. The following entities - for limitation - shall the right to directly challenge at the Constitutional Court the constitutionality of the applicable laws and regulations:
a. The Senate.
b. The House of Representatives.
c. The Council of Ministers.
2. In the case viewed by courts, any of the parties of the case may raise the issue of the non-constitutionality; the court shall - if it finds that the plea is serious - refer it to the court specified by the law for the purposes of the determination of its referral to the Constitutional Court. - English(1) Subject to the provisions of section 40(7) of this Constitution, an appeal shall lie from decisions of the High Court to the Court of Appeal as of right in the following cases:
(a) final decisions in any civil or criminal proceedings on questions as to the interpretation of this Constitution;
(b) final decisions given in exercise of the jurisdiction conferred on the High Court by section 16 of this Constitution (which relates to the enforcement of the fundamental rights and freedoms).
(2) An Appeal shall lie from final decisions of the Public Service Board of Appeal to the Court of Appeal.
(3) The Chief Justice may make rules with respect to the practice and procedure of the Court of Appeal in relation to appeals from the Public Service Board of Appeal to the Court of Appeal. (Sec. 105)

- EnglishThe Constitutional Court decides obligatorily on:
– the treaties and international agreements before their entry into force, concerning their conformity with the Constitution, after the adoption by the Parliament of the law of authorization;
– the constitutionality of the organic laws and of the laws before their promulgation, as well as of the ordinances after their publication;
– the regulations of the National Assembly and of the Senate, the regulations of procedure of the Constitutional Court and the regulations of the Economic, Social and environmental Council, before their implementation, concerning their conformity with the Constitution;
– the regulations of the independent administrative authorities determined by the law, before their implementation, concerning their conformity with the Constitution;
– the conflicts of attribution between the institutions of the State;
– the regularity of the presidential [and] parliamentary elections, and of the operations of the referendum of which it proclaims the results.
The Constitutional Court is referred to [the matter] in case of dispute concerning the validity of an election, by any elector, any candidate, any political party or delegate of the Government under the conditions provided for by the organic law on the Constitutional Court. - EnglishThe Supreme Court of Justice through the Constitutional Chamber will be the sole tribunal competent to declare the unconstitutionality of the laws, decrees, and regulations, in their form and content, in a general and obligatory manner, and it may do so on petition by any citizen. (Art. 183)

- English(1) The Constitutional Court has jurisdiction over the whole Spanish territory and is entitled to hear:
a) Appeals against the alleged unconstitutionality of acts and statutes having the force of an act. ...
b) Individual appeals for protection (recursos de amparo) against violation of the rights and liberties contained in section 53(2) of the Constitution, in the circumstances and manner to be laid down by law.
c) Conflicts of jurisdiction between the State and the Autonomous Communities or between the Autonomous Communities themselves.
d) Other matters assigned to it by the Constitution or by organic acts.
(2) The Government may appeal to the Constitutional Court against provisions and resolutions adopted by the bodies of the Autonomous Communities, which shall bring about the suspension of the contested provisions or resolutions, but the Court must either ratify or lift the suspension, as the case may be, within a period of not more than five months. - EnglishThe declaration of unconstitutionality of a law and its abrogation [derogación], may be solicited, by anyone who considers himself injured in his direct, personal, and legitimate interest:
1) By way of action that must be brought [entablar] before the Supreme Court of Justice;
2) By way of exception. which may be opposed in any judicial proceeding; and
3) Also[,] the Jurisdictional Organ that takes cognizance in any Judicial proceeding may solicit[,] of office[,] the declaration of unconstitutionality of a Law and its abrogation before dictating a decision [resolución].
In the cases contemplated in numerals 2) and 3), the activity [actuaciones] must be elevated to the Supreme Court of Justice[,] the procedure following from the moment of summons for decision [sentencia], after which the judicial procedure of the partial question in the sphere of the resolution concerning the unconstitutionality must be suspended. 1) Por vía de acción que se debe entablar ante la Corte Suprema de Justicia;
