Limitations and/or Derogations

At the time of the occurrence the following situation, the rights under Section 3774 shall not be suspended unless the public safety may so require:
(a) in time of war;
(b) in time of foreign invasion;
(c) in time of insurrection. (Sec. 379) - Burmese
အောက်ဖော်ပြပါ အခြေအနေတစ်ရပ်ရပ်ပေါ်ပေါက်ချိန်တွင် အများပြည်သူလုံခြုံရေးအတွက် လိုအပ်သည့်ကိစ္စမှတစ်ပါး ပုဒ်မ ၃၇၇ ပါအခွင့်အရေးများတောင်းခံပိုင်ခွင့်ကို ရပ်ဆိုင်းထားခြင်းမပြုရ -
(က) စစ်မက်ဖြစ်ပွားချိန်၊
(ခ) တိုင်းတစ်ပါးမှ ကျူးကျော်ဝင်ရောက်တိုက်ခိုက်ချိန်၊
(ဂ) ဆူပူသောင်းကျန်းမှုများဖြစ်ပေါ်နေချိန်။ (ပုဒ်မ-၃၇၉)
Limitations and/or Derogations
- EnglishExcept in the following situations and time, no citizen shall be denied redress by due process of law for grievances entitled under law :
(a) in time of foreign invasion;
(b) in time of insurrection;
(c) in time of emergency. (Sec. 381) - Burmeseအောက်ဖော်ပြပါ အခြေအနေနှင့် အချိန်အခါမှတစ်ပါး နိုင်ငံသားများ၏တရားဝင်ရပိုင်ခွင့်ရှိသော နစ်နာချက်များအတွက် ဥပဒေဖြင့် သတ်မှတ်ထားသော ရယူပိုင်ခွင့်များကို ငြင်းပယ်ခြင်းမပြုရ -
(က) တိုင်းတစ်ပါးမှ ကျူးကျော်ဝင်ရောက်တိုက်ခိုက်ချိန်၊
(ခ) ဆူပူသောင်းကျန်းမှုများဖြစ်ပေါ်နေချိန်၊
(ဂ) အရေးပေါ် အခြေအနေ ဖြစ်ပေါ်နေချိန်။ (ပုဒ်မ-၃၈၁)
Limitations and/or Derogations
- EnglishThe President, in promulgating an ordinance and declaring a state of emergency :
(a) shall specify in the said ordinance the areas and the duration that the state of emergency is in operation;
(b) may, if necessary, restrict or suspend as required, one or more fundamental rights of the citizens residing in the areas where the state of emergency is in operation. (Sec. 414) - Burmeseနိုင်ငံတော်သမ္မတသည် ဥပဒေကဲ့သို့ အာဏာတည်သည့် အမိန့်ထုတ်ပြန်၍ အရေးပေါ် အခြေအနေ ကြေညာသည့်အခါ -
(က) ယင်းအမိန့်တွင် အရေးပေါ်အခြေအနေ အကျိုးသက်ရောက်သည့် နယ်မြေဒေသနှင့် အချိန်ကာလတို့ကို သတ်မှတ်ဖော်ပြရမည်၊
(ခ) လိုအပ်ပါက အရေးပေါ်အခြေအနေ အကျိုးသက်ရောက်သည့် နယ်မြေဒေသအတွင်း နေထိုင်ကြသော နိုင်ငံသားများ၏ မူလအခွင့်အရေးတစ်ရပ်ရပ်ကိုဖြစ်စေ၊ တစ်ရပ် ထက်ပို၍ ဖြစ်စေ လိုအပ်သလို ကန့်သတ်နိုင်သည် သို့မဟုတ် ရပ်ဆိုင်ထားနိုင်သည်။ (ပုဒ်မ-၄၁၄)

- EnglishThe Commander-in-Chief of the Defence Services may, during the duration of the declaration of a state of emergency, restrict or suspend as required, one or more fundamental rights of the citizens in the required area. (Sec. 420)
- Burmeseတပ်မတော်ကာကွယ်ရေးဦးစီးချုပ်သည် အရေးပေါ်အခြေအနေ ကြေညာထားစဉ် ကာလအတွင်း လိုအပ်သည့်နယ်မြေဒေသတွင် နိုင်ငံသားများ၏ မူလအခွင့်အရေးတစ်ရပ်ရပ်ကို ဖြစ်စေ၊ တစ်ရပ် ထပ်ပို၍ဖြစ်စေ လိုအပ်သလို ကန့်သတ်နိုင်သည် သို့မဟုတ် ရပ်ဆိုင်ထားနိုင်သည်။ (ပုဒ်မ-၄၂၀)

According to Sec. 377 of Chapter VIII- Citizen, Fundamental Rights and Duties of the Citizens: “In order to obtain a right given by this Chapter, application shall be made in accord with the stipulations, to the Supreme Court of the Union.”
